I130 approved but not yet at NVC

My uncle petition my aunt as he is a US citizen and the filled back in 2001 and got approved in December 2005 but since then we have contacted the NVC and they tell us that the case is not yet with them and at USCIS they tell us they send it so what should we do? my uncle tried infopass but it was a waste of time one officer told him he has to wait as is a brother petition and it takes 12 years that's all he didn't even take a look on the case just told him that. any advice?

If sister, she falls under F-4 Class, DOS is currently assigning numbers to cases filed September 1997, so case may be in storage waiting for a number, so NVC may not have anything on it as of yet.

I am not sure where cases get stored, either at USCIS or NVC, but they get held until a visa number becomes available for the petition.

Someone needs to say something about where his case is because it can't just be in limbo. I don't know about petitions between siblings but I do know that my aunt, whose only a permanent resident filed for her son a few years ago. Back in June the USCIS approved his petition and it was sent to the NVC withing a week. A week later a case # was assigned to him and every time you call the NVC, the automated message says that they have the case but have to wait for a visa # which could take 5 more years or so. That we knew, but at least we know where the case is right now. I'm thinking that's the way it probably works for other petitions.

I just can't imagine having the USCIS approve a petition and no one knows where it is for sure. If it's stacked away because they're waiting for a visa #, then they should at least say that it's in such and such place. I would contact the USCIS one last time and if it doesn't work then contact your local representative (congressman or senator) for help because this situation is not acceptable.
