I'm not at the Adjustment of Status stage yet (still waiting for the K1 Fiance Packet; I am the US citizen), but I was looking over the next stage and was a little confused about the I-864EZ.

I am planning to use the I-864EZ since I am the petitioner (I will be the wife), I am using my own income (I am over 125% of the poverty line), and my fiance will be the only person immigrating (on a K1 visa).

Regarding the household size, there will just be the two of us... so in Part 4, regarding the household size, 16A is pre-filled out at 2... and I can just leave the rest of question 16 blank and have 16F equal 2, right? I would leave 16B blank since he's already being counted in 16A, right?

And then regarding question 19 (Federal tax info), I would submit:

tax transcripts for 2007, 2006, and 2005, plus W2s

my 1040 for 2007

my employment letter

6 months of paystubs

Is there anything else that goes with the I-864EZ?

I haven't heard about having to file the I-864EZ. The instructions say that you fill out the I-864 (without the EZ):

"Submit an Affidavit of Support (Form I-864) if your adjustment-of-status is based on your entry as a fiance(e)(...)" (Read part 14 A. on page 4 of the instructions for I-485)

I thought I could use the I-864EZ instead of the I-864 because I meet 3 conditions (I am the sponsor, I am using my income to reach the 125% over poverty line, and I am only sponsoring 1 immigrant)?

Could someone else chime in?

If you read the instructions for this form, you will notice that you can file this form if you meet all of the following criteria:

1)You are the person who filed or is filing the form I-130, Petition for Alien Relative

2)The Relative you are sponsoring is the only person listed on the I-130 Petition

3)The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former amployer(s)

You do not meet the first criteria because you filed form I-129f not I-130.

I know of someone on this forum (Evan, if I'm not mistaken) who met all the three criteria (filed I-130) and sumbitted an EZ, yet received an RFE requesting he files the I-864. The 864 is not that much longer than the EZ anyway.
