i have a question about the I-864 form. I looked up the sample forms but we are confused.

Your Household Size - DO NOT COUNT ANYONE TWICE

Part 5. Sponsor's household size.

Persons you are sponsoring in this affidavit:

  1. a. Enter the number you entered on line 10. ------1 (me)
  2. Persons NOT sponsored in this affidavit:

  3. b. Yourself. -------1 (my hubby)
  4. c. If you are currently married, enter "1" for your spouse. -------------------1 (me again) or should we put 0 there? he said we should put 1 since we are married.

  5. d. If you have dependent children, enter the number here. -----0
  6. e. If you have any other dependents, enter the number here.----0
  7. f . If you have sponsored any other persons on an I-864 or I-864 EZ---0
  8. who are now lawful permanent residents, enter the number here. ---0

household size: 2 or 3? obviously it's only 2 but add all the 3 ones ...confusing...sorry. now i feel dumb dumb :(

AOS -
08-08-08 - Filed AOS with EAD and AP
08-18-08 - NOA for EAD,AP and AOS
08-21-08 - Received Biometrics Appointment Letter
09-09-08 - Biometrics Appointment 10am Kansas City
09-18-08 - I-485 transferred to CSC (got an email from USCIS)
10-07-08 - EAD Touched
10-19-08 - My birthday / Found out I am Pregnant!
10-22-08 - Grief, Pain, Sadness
11-06-08 - EAD card ordered; AP approved (USCIS website)
01-16-09 - AOS Touched
02-23-09 - Green Card (conditional) and welcome letter received in the mail
02-24-09 - Got the job in boyce and bynum lab

You put 1 on the first line. You put 1 for yourself. SKIP the spouse line. Total is 2.

(The spouse is if you are sponsoring someone else - like a child- and then you would have to count your spouse)

This is not confusing, if the person being sponsored is spouse then they are counted as immigrant FIRST as the immigrant and NOT counted as spouse.

Later if US citizen were to perhaps sponsor another immigrant like a step child following to join then sponsored spouse will be counted as spouse and not as immigrant.

In the section where it says: "persons NOT sponsored in this affidavit", you have to put "0" at point

c. If you are currently married, enter "1" for your spouse.

The reason is that you have already mentioned yourself as a person that IS sponsored in the affidavit, therefore you cannot repeat that in this portion of the form.

If the petitioner would file for a child, for example, then he/she would put "1" if he is married, and "0" at point

d. If you have dependent children, enter the number here.

That's because the child in this case would have already been mentioned as "person sponsored in the affidavit".

You put 1 on the original line and then 1 under spouse. (You can't count yourself twice)

Wrong :no: You are telling them to count themselves twice by indicating 1 as immigrant and 1 as spouse. They are counted only as immigrant if spouse is being sponsored.
