Hello,

How likely will it be that my fiance would be able to visit me in the United States while the K1 application is being processed, has it worked for anyone? I would also like to know about how it would work if he was able to visit me during the K1 application being processed considering he would need to get back to Canada in time for the K1 visa (medical exam and interview I believe it is, right?) when it is approved. I read that to be able to visit me he should bring a ticket to return to Canada later (we're not sure when that should be either considering the K1's processing times can vary, we just know that the longest amount of time he could be with me there as a visitor is 6 months) when he is coming to the states to visit me, is this something that should definitely be done and how would we pick a return ticket date? What other things should be done to make his visit possible? Is it likely that he will be able to visit me, for 6 months or under, during the time that the K1 visa is being processed?

Should he get his passport now regardless of when he will be visiting me during the K1 being processed even though we aren't sure when that will be yet? Thank you so much for your time!

hey

i just got back last week from visiting my fiance in the states. Thing is it is a red flag when u say your visiting your fiancee and i was taken into boreer control where i was questioned. They went through all my luggage ect and the told me the reason they let me through was because i was conpletley honest with them. So yes you can go...but my advice is just be 100% honest, dont lie because all they have to do is do some research on the computer and find youve filed for k1. I only stayed for a week. I would say stayin for longer than 2-3 weeks would make things more difficult for you because they would be suspicious on your intent to stay and doing things illegally so just keep it short!

I was fine and after 40min i was let through so keep the stay short be honest and oull be fine!!

Good luck

Many have done so successfully, some not so successfully. It is at the discretion of the CBP. If your fiancé visits you he will need to show strong ties to Canada such as a letter from his employer stating when he is to return to work, mortgage or lease agreement, bills, loans, etc., anything that will prove he has no intent on immigrating at that time. Lying to the CBP is NOT advisable...just answer the questions asked and not volunteer any other information. If you care to get more feedback on this, visit the Canada Forum as there are many who have travelled to visit their fiancé(e)s while the K1 is in the works. It is not always considered a "red flag" to state that you are visiting your fiancé(e).

Or they can say you are attempting to move to the US you just never know with border patrol. It all depends on the CBP officer. We went through CBP and told them we were going to get married and we were in our wedding clothes not a single word from CBP. We went through another time and got the 3rd degree. CBP officers can do whatever they want which is the problem. If you have a tourist visa they should just let you through and not have the freedom to decide if you are allowed or not. Why issue a visa if they aren't going to let you in? My wife was so happy when she got her greencard because CBP doesn't say a word to her anymore. I told her once she has a US passport she can stick her tongue out at them and they can't do anything. She lived her whole life having to deal with CBP being rude to her everytime she crossed the border. Living in a border town most of her life she has seen so much change. When she was young they never even asked her for anything when she crossed the border. Now they ask you a thousand questions everytime you cross. I understand they are trying to stop illegals and people from overstaying but for people that cross hundreds of times they should know will go back home. Also along our southern borders you have an additional checkpoint you have to go through once you get 50 miles or so into the US.

Hi there, as i noticed in the posts - and agree completely - it is important that your fiance be honest when visiting you in the US.

I am from British Columbia and am here in Indiana visiting my Fiance on a B2 visitor visa until mid-august. I packed up my car, cat and drove here and went thru one of the border crossings along the Alberta/Montana border. The border guys gave me a bit of a hard time (ie: short interview, checked out my car to make sure i wasn't 'moving' here with house belongings), however, i was honest about the fact i have a business in Canada, that we filed for our K1 and since the paperwork is in process, why would I want to 'screw' this up? Anyway, because the paperwork wasn't in the system yet i went thru a short interview in order for them to best figure out how to admit me and for how long. At the end of it all, they apologized for upsetting me.

The good side to all of this is that we filed for the K1 Visa in Febuary and I just heard 3 days ago that it was approved  and they are now mailing the forms (not sure if they are m ailing them to my address in BC or to my Fiancee here in Indiana...).

So, that is about it. Hope your process goes very smoothly and we wish you all the best success!

I've visited my US fiancee a few times and been completely honest with the officers. I just stayed calmed and polite, answered all questions. I also brought a letter from my university stating that I was enrolled for another year and had a copy of my flight itinerary but they;ve never asked to see it. It's never taken more than two minutes.

thanks so much for your replies, everyone, i really appreciate your help. my fiance is unemployed and is not in school, he also lives with his mother at the time so he doesn't really have any proof that he would be coming back except for his cats and his stuff that he wouldn't be taking with him to visit me. are there any other ways to prove that he would be returning to canada? i would be able to support him if he was to visit me for several months until it was time to go back to canada for the K1, if it would be possible for him to stay that long, and would provide proof for that but i'm not sure how else he could prove he's returning to canada except for a return plane ticket. would it be less likely that they would let him through to visit me as a fiance with a K1 in process and more likely to let him visit as a fiance without a K1 in process yet? Could he come to visit me before starting the K1 application process and then while he's visiting we get the K1 started from there (which may also be good because then we could use his boarding passes and itinerary from him visiting me for proof of having met in the past two years as well as my having been in canada before and proof of that)? Would that create a problem for the K1 being processed or approved at all if he was with me in the states when we sent in the application and also while it was being processed, then him going back to canada at probably about the 5th month that he'd be there? I read that processing times for the center we'd be using is about 6 months now, so if he left at the 5th month he'd most likely be there earlier than when the K1 would be approved.
