applying for SSN

Question 3 on the SS-5 form asks if you are

- U.S. Citizen

- Legal Alien Allowed to Work

- Legal Alien Not Allowed To Work

- Other

Which do we put? L.A. Allowed or Not Allowed? The border guard who processed my SO's visa told us he could work right away but didn't actually give us the temp EAD stamp. Does this even have any bearing?

I read the instructions pertaining to this question but I'm still confused.

I tend to disagree. I think since you didn't get the Temp EAD at the POE, you may not be able to put "eligible to work" since there is no evidence of that. However, I will add that the girl at the SS office we have here did not recongize the stamp (it was quite blurry), and she had to do a search in her system for my wife's A# and found that she was given a 90 day EAD. Perhaps you could try to tell the SS officer to check the A#. Maybe you'll have some luck.

I put Legal alien allowed to work don't hve problem with it..

I did not get the temp EAD stamp at the POE.I provided the same answer on the form & I got my SSN card a week after.
