Visa Denial contested...same day

We both went to the interview last Wednesday 18th and as I guessed it, arrogant americans working there. At the first interview I am sure the lady decided to deny the visa within the first minute as she turned the light on for the next person almost immediately after Bing entered the room. I do not have enough income.

Sure enough at window 36 another lady called our number and announced that we were denied the visa because Bing would become a public charge... I stepped up to the plate and told her of assets and house etc, she announced the papers were irrelevant without a deed, etc etc etc. I insisted she forward the information to someone in a higher position and she did.

Window 33 a man called Bings name and we both went there. I again explained that I have assets in excess of whats needed, he asked if anyone asked to review the documents and I told him None asked. I produced more documents, bank deposits, house statements etc and he added things up and was still in question until he asked a knowledgeable Filipino man that clearly said that I have adequate funds and to reverse the denial in the computer.

The funny thing about it all is since it was decided at the first interview a denial, the rest of the paperwork was not looked at closely. I suppose it would have been reviewed when the visa denial was contested sometime in the future but since it was contested the same day it was not. The I-134 was not signed, employer letter not reviewed, paperwork not looked into. Only thing reviewed during the day after the first interview was bank statements and house statement and tax bill.... The man looked like he was embarrassed that he was unsure how to proceed with a case such as ours.

Low income and no co-sponsor... no biggie. I knew this would be an issue that Bing alone would not know how to contest and planned to fly for the interview. 3 weeks notice made it hard to get things in order but I did. Too bad none of it was looked at LOL

All that is needed is the stamp indicating PDOS was completed (not open today) and we are good to go back to the US on Thursday... What a hectic few weeks we have both been through. I am glad this is almost completed after all this time.

Obviously your lady would have been "hung out to dry" if you hadn't been there.

I've always recommended the petitioner attend the interview even tho many say it's not necessary.

You made a GOOD move. LOTS of guys are still kicking themselves in the puwit for not attending!

Looks like you asked to pick up the visa also?

You are very lucky and congratulations! I was in the same situation before. My hubby was still a student at that time and our sponsor was his mom. I initially got denied too! On the day of my interview, they told me that my hubby and his family cant afford to bring me the US yet cuz the income that they've presented wasnt enough. So they denied me as likely become a public charge. Even though, I insisted my hubby's familys assets, like the fully paid house. But they didnt consider it too! I went out the embassy on that day crying! i thought i had to go through to another new applications/petition. In my case, my hubby had to find work immedietly so we could present his income. So after 3months i went back to embassy. And we submitted all the docs that we could present, after 3weeks i got my visa without another or second interview. That was the only time i felt so relief. Good Luck on your journey and God Bless!
