Hey Everyone!

We got an RFE for the I 864 ,affidavit of support.We finally got the documents,and have to mail it until this friday.

Since I do not want to mess it up,please help !

1.:

Do we have to notarized the employment letter for the form I-864?

2.It is enough if my husband(the petitioner) will send in only his MOST RECENT tax return with the I 864 form?

(I have a Co sponsor,who totally eligible to be my sponsor,we will send in his tax returns for the last 3 years.)

Any help would be appreciated!

2.Yes, you are supposed to send only last year's tax return

If your husband is fine with his most recent tax return and exceeds the guidelines you don't need your friend. When you're sending the documents in for the RFE act like you never sent anything in before. So include the W2 forms again and some paystubs. The job letter isn't necessary but the more the better, you know? So it wouldn't hurt if he could easily get it.

If your husband is fine with his most recent tax return and exceeds the guidelines you don't need your friend. When you're sending the documents in for the RFE act like you never sent anything in before. So include the W2 forms again and some paystubs. The job letter isn't necessary but the more the better, you know? So it wouldn't hurt if he could easily get it.

We never sent the I 864,because our lawyer told us that we will be fine without sending it in...((((

We got the RFE,for the I-864.

I am really nervous about it because I NEED to know,if my hubby has to send in anything else than his MOST recent tax return.

We requested the transcripts from the IRS one month ago,they told us,we will get it within 2 weeks,it never arrived.

We called them again,we were told,be patient..((But we have time until this friday.

(My husbands income is not enough,so that is why we have to use a co sponsor..)

Yes,Because Our lawyer told us to do so, but it was obviously a MISTAKE.

Get a joint petitioner. Since your husband doesn't work right now they'll send you ANOTHER RFE on top of the one you're gonna get for not sending the I-864 with the rest of the AOS application.

Get a joint petitioner. Since your husband doesn't work right now they'll send you ANOTHER RFE on top of the one you're gonna get for not sending the I-864 with the rest of the AOS application.

Does this mean another person to fill out another form I-864?

My only petitioner is my husband,his income is not enough,BUT (thank God we have an eligible Co sponsor already)

My original question was,that :

He does NOT have to submit his tax returns from 2006,2005?(I read in the I 864 Instructions that this is optional.You HAVE to submit the MOST RECENT tax return ,and to submit more returns from previous years,is an OPTIONAL thing for the petitioner.Am I right??

(the IRS messed up something,we never received the transcripts)
