Timeline

HI,

Canadian married to LPR since April 2007 with 2 kids under 21 files I-130 jointly for myself and both kids.

We filed our I-130 petition in April 2007 and have had only one touch since then because we asked our Congresswoman to enquire about the status of the file.

Since speaking with the congresswoman I have been informed by the consulat in Montreal that we would qualify for a V visa once we have reached the 3 year pending case date. When I searched on the USCIS webiste under the LIFE Act it clearly talks about petitions filed before or during 2001. Can anyone clarify this information and if the ifnroamtion contained on the USCIS website is accurate? Is there any truth to this V Visa possibility?

In addition can anyone tell me, should we qualify for V Visa, if it is accurate that USCIS notifies NVC (I was told this by MTL Consulat) and the NVC contact us or should I be looking for a form that requires completion for the V Visa?

Maybe I am getting my hopes up for nothing....again......

sorry for disappointing u but that is the truth. that V visa is not valid right now. it was for petition filed before dec 2001.

so u do not qualify for V visa .

waiting period for your category (F2A spouse of LPR) is currently like 5 years.

U need to wait for yr spouse to be a U.S citizen .

05/03/2004 - I-130 Sent to Texas Service Center

05/19/2004 - Rec'd NOA1 Hard Copy.

03/20/2006 - case sent to California Service Center.

06/09/2006 - NOA2 - Approval Notice received.

05/28/2008 - Became a U.S Citizen. mailed them copy of certificate of citizenship and request to upgrade category from F2A to IR1 .i got a category changed to IR1 confirmation mail RECEIVED on 06/16/2008.

05/19/2008 - DS-3032 and AOS Fee bill Generated.

05/28/2008 - DS-3032 E-mailed.

05/27/2008 - Paid AOS Fee by Mail.

06/09/2008 - AOS Fee received and wait for further instruction(NVC AVR message)

06/21/2008 - Received I-864 In mail

06/23/2008 - Return Completed I-864 (Express mail)

06/06/2008 - DS-3032 Acceptance E-mail Rec'd.

06/24/2008 - I-864 Entered into NVC System.

06/09/2008 - IV Fee Bill Generated.

06/09/2008 - Paid IV Fee Bill. Payment Status: IN PROCESS

06/10/2008 - IV Fee Bill Payment Status: PAID. DS-230 Generated.

06/27/2008 - Received documents from Husband.

06/28/2008 - DS-230 Mailed(Express mail).

06/30/2008 - DS-230 Rec'd by NVC (11:25AM)

07/01/2008 - DS-230 Entered into NVC AVR.

07/07/2008 - AOS Accepted.

07/09/2008 - CASE COMPLETE!

??/??/2008 - Case forwarded to consulate

07/14/2008 - I received interview letter

08/26/2008 - Interview Date 7:30 A.M.

08/26/2008 - Visa Approved.

09/03/2008 - POE at Newark

10/16/2008 - received Green card.

Yep, the link I posted has this:

Lawful Permanent Resident (LPR) petitioner MUST have filed the I-130 immigrant visa petition on or before December 21, 2000;
