Timeline

On the I-864 I am filing with the AOS, and it doesn't mention anything about having to get it notorized in the instructions, but I think I read someone here say that you shouldn't sign this form until in the presence of someone notorizing it. Do we need to notorize this I-864?

It also asks to list people who are not included in the sponsoring and lists 'Spouse'. I am the spouse and I'm the person being sponsored. I know it says don't list the same person twice so we just put a 0 there.

Oh... And can someone confirm that this is the correct address bearing in mind I am filing as an approved I-129F?

It said on the form something about sending it to Nebraska if you lived in Ohio, but that was something to do with the I-140 which I am sure doesn't apply.

Some editions of the Form I-864 and Form I-864A include a jurat to be completed by a notary or by a consular or immigration officer to show that the person signed or acknowledged the signing of the Form I-864 or I-864A under oath. The Form I-864 and Form I-864A, however, provide that they are signed “under penalty of perjury.” Thus, 28 USC 1746 (which deals with the legal effect of unsworn statements) makes it unnecessary for Form I-864 and Form I-864A to be signed in the presence of or certified by a notary public or an Immigration or Consular Officer. Note that the jurat has been removed from the January 15, 2006 edition of the Forms I-864 and I-864A. Form I-86EZ is a newer form, and therefore never had the jurat.

Your spouse is first the immigrant being sponsored so you do not count them as spouse. ONLY if later were you to sponsor someone else like a parent or child would you count as spouse.
