Question about AOS for K3 visa holder

Hi there,

I ve read the guide to apply for AOS after entering the US on a K3 visa. My question:

How am I supposed to make a copy of the NOA2 of the I-130? I got the NOA1, but the reason why I enter the US on a non immigration -K3- visa is still that my immigration visa (I130) isnt approved yet. And as far as I know I get the NOA2 as soon as it is approved. So.....how should that work? Im really confused. Did i get something wrong here???

I actually thought that I might be able to adjust my status in America without returning to my homecountry for the interview.

I would really appreciate your help.

Smooth journey for all of you

Isabel

You need to have your NOA 2 from I-130 before applying for AOS . Once NOA 2 is approved you have choice to either apply for AOS here or wait to continue your CR1 in overseas once you have the package from NVC .

abdullah,

Not true. The I-130 does not have to be approved before a K3 can apply for adjustment of status.

Isabel,

You can apply for adjustment of status from K3 without returning to your home country and without having your I-130 yet approved. And you correctly observe that in the latter case you cannot include a copy of the I-130 Approval Notice with the application for adjustment.

You're in the USA as a K3 - submit the I-129f Approval Notice. That's what my wife did (sort of).
