newbie NA1 question

Hello,

I have been a member for a while but have not posted.

I'm getting more active in the community now.

My question is... I sent my application on 10/15/07. My NA1 has a received date of 10/17/07 and a notice date of 01/11/08. When I check my case online it states that my application was received on 01/11/08.

Which date am I looking at to check the Processing Times on the USCIS website. It better not be January because they are on July still. Anyone had this problem?

I think your question was debated with many VJ people. Different members have different opinions. Some say the Filing date is respected and some say NOA1 is respected. If you feel which they are refering you better call USCIS and ask them which they are refering. Some people claimed that there was an error. In our case I called and found out that they are honoring the application date ( unlike what you see on screen) and they have it on their system that our application is considered as october filer not NOA1 which is january. We called one and half month ago before being approved. We never get any touch.

I too had the same doubt but NOA 1 hard copy clearly states received date as the "actual received date", 17/10/07 in your case. Did you check that in your hard copy?

But better to call USCIS to clear your doubts.

5th Jan 2008 - Received NOA 1

16th May 2008 - Approved (NOA2 in 247 days )

18th May 2008 - Touch (Guess its been sent to USCIS mail room)

20th May 2008 - Received Hard Copy NOA2

I 129 F

7th Jan 2008 - Sent I 129 F to CSC

10th Jan 2008 - Received by CSC

18th Jan 2008 - Received NOA 1

16th May 2008 - Approved (NOA2 in 130 days )

18th May 2008 - Touch (Guess its been sent to USCIS mail room)

20th May 2008 - Received Hard Copy NOA2

21st May 2008 - Received Docs at NVC

xxx xxx xxxx - Case # generated

28th May 2008 - Sent to USEM Colombo

29th May 2008 - USEM Colombo confirmed receipt

I called VSC and they say that our app. date is October and that they "honor" that date. However, they have repeatedly told my congressman that no formal action can be recognized until 6 months past the NOA1 date. so...while they "recognize" that date it doesnt mean anything, because they are "protected" by that NOA1 date since that is the date they actually BEGAN your petition..when it was "opened an put in the system". They can say that we are october filers..but it doesnt mean anything basically

10-17-08 RFE, DS230

10-28-08 CASE COMPLETE!

2-19-09 INTERVIEW 8:30am, APPROVED

Thanks so much you guys... this is a huge help to be able to ask questions. Well... I called USCIS and they assured me that the date they would be working off of would be the actual "date received" of October '07 even though my NOA1 date is Jan. '08.

they have repeatedly told my congressman that no formal action can be recognized until 6 months past the NOA1 date

This makes a lot of sense and they are definitely buying themselves some time with this "technicality"
