Finally....CR1 + K3 APPROVED on 05/08/2008

I see that you guys have been approved on both petitions. What are you going to do? Which way are you going? K3 or CR1? I was approved on May 6 and I am really confused right now and don't know what to do next. Do I get to Choose or does NVC choose for me?

And something else.. What's written on your I-130 NOA2 first paragraphs? Mine says "and will apply for adjustment of status. He or she should contact the local USCIS office..." bla bla bla. Did everyone get this? I am the beneficiary.. but I'm NOT in the US!!!!! What is this?

Yes, I got the message too.

I am going to proceed with both CR1 + K3, but we will hold on to CR1 and not send back any documents until few months later when the K3 physical file arrives in China. This is so that if my husband fails K3 interview, we know he still have another chance for CR1. I know this means we will be spending more $$, but getting the visa for him is more important. How about you?

So the same text is on your I130 NOA2? Can you please double chech for me? I would be forever grateful, because my husband got scared of the part "The petition indicates that the person for whom you are petitioning is in the United States " and I'm actually still in Romania :(( I am really scared something's wrong.... please help me

Uscis is saying that since both are approved I-129F is cancelled and I-130 is oly valid.... NVC says that it's the I-129F being sent to the embassy and I-130 is being held for future adjustment of status.... The embassy is saying we can choose which to pursue and I don't understand anything anymore :(

So please for my sanity... look and write here what's written on your I-130 NOA2... please

I would call and verify that with USCIS so that they will send it to NVC instead of you local office. It sounds like a box was checked wrong. That will be a big issue if it is not corrected

I'm going K3 so I don't want I130 at NVC. I just want I129F at NVC and then to the embassy. I was just worried about that paragraph but from what I've been reading and talking to VJers it's a standard formula for NOA2 of I130. I'm just keeping fingers crossed my approved I129F reaches the embassy soon, so this way I know for sure I'm still on the K3 route. My lawyer was trying to persuade my husband that if both petitions are approved at the same time the I130 gets priority and I129F gets cancelled. I refuse to believe that...

- jan. 12 2008 - Wedding

- feb. 11 2008 - sent I-130 to Chicago lockbox

- march 06 2008 - sent I-129F to CSC

- may 06 - APPROVED

- jun 12 - medical and interview passed! Visa in the passport!!!

- jun 24 - entry in US through Chicago

AOS

- jul 16 2008 - AOS + EAD sent to Chicago lockbox

- jul 28 - NOAs for AOS and EAD

- aug 6 - Bio letter

- aug 11 - RFE e-mail (I-864)

- aug 19 - Biometrics done (they scanned my little fingers maybe 20 times because fingerprints were not clear enough :P )

Timeline

Since both were approved, you will most likely be forced to go the K-3 route anyways, so you don't have to worry about that too much. But you still need to contact NVC because if you don't they will send it to the local office and not the foreign consulate.

I-130 Timeline:

12-11-2007- Married my Love

02-08-2008- CSC receives I-130

02-11-2008- Received Hardcopy NOA1

08-14-2008- Approved!!! 216 days...

08-21-2008- NOA2 Hardcopy received

08-27-2008- NVC Receives file, NVC Case Number issued

09-05-2008- AOS Fee Bill and DS-3032 Generated

09-06-2008- E-mailed DS-3032 to NVC

09-11-2008- Received Hardcopy of DS-3032 and AOS Fee Bill

09-15-2008- Mailed Hardcopy of DS-3032

09-16-2008- Paid $70 AOS fee online

09-17-2008- Received E-mail confirming the DS-3032 Agent

09-17-2008- Printed Coversheet for AOS paperwork

09-17-2008- IV Bill Invoiced

12-16-2008- Sent I-864 EZ to NVC

We got both of ours approved on 5/08/2008 as well.

I was notified by email. I'm sure I'll get the physical NOA's in the mail in a week or so.

I don't know if they will end up sending us the K3 packet or the CR-1 packet, but by the looks of it, they appear to ask for basically the same stuff. I'm hoping they just send us the forms and then in the interview they decide to give her the CR-1 visa since it'll mean less work for them in the long run, too. Then my wife can go to work right away and help our economy.

Apparently I made a mistake.. I didn't paste the entire paragraph. here's what it says:

"the petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status. He or she should contact the local USCIS office to obtain Form I-485 Application for Permanent Residence.

If the person you are petitioning for decides to apply for a visa outside the United States based on this petition, the petitioner should file Form I-824, Appplication for Action on Approved Application or petition, with this office to request that we send the petition to the Department of State National Visa Center (NVC)".

I was more worried about the "person for whom you are petitioning is in the United States" part... but from what i understood it's a standard sentence.
