Timeline

Hi all

My SO has been in America for just over 1 year now. We were married on June 6th 2007. Everything is going great, we're both very happy. We were going to make a trip back to China this year and visit with the family again but decided instead to bring her mother and her niece to America and take them on a site seeing tour. Their stay may be between 2 and 3 months. I think a 3 month stay conflicts with the airline maximun stay period for a round trip ticket, but that's not the point of this post. While filling out the I-134 under item 3. ( 3. That this affidavit is executed on behalf of the following person) I put her mother and her niece under child, this part i'm clear on. But further down on the form, Items 9 and 10...

9. That I have previously submitted affidavit(s) of support for the following person(s). If none, state none.

10. That I have submitted a visa petition(s) to U.S. Citizenship and Immigration Services (USCIS) on behalf of the following person(s). If none, state none.

To my understanding my wife is enclosing the affidavit of support and the visa petition along with the I-134 (for the first time) So do I list her mother and niece under items 9 and 10 also? She may be sending this all to her mother so she can apply at the American consulate in Shenyang, China. So I'm not sure of the date and time they'll be submitted, which is why i'm uncertain to put their names in items 9 and 10.

Any advice or direction concerning this would be greatly appriciated.

One final thought. When they ask if i have ever submitted an affidavit of support could they be referring to the affidavit of support that was included with my original K-1 visa? or the step 2 in China that my SO took to the American consulate for her interview? It seems like I've submitted this a couple times while trying to get the original K-1 visa process completed. in that case would they be asking me to put my SO in items 9 and 10?

One final thought. Unless China is different wifes mother and niece must qualify finacially on their own.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Correct, also will need to demonstrate very strong ties to China, and very strong incentive to return to China and not overstay the visit to the USA. The US consulates are very quick to deny visitors visas.

Not sure, but i'll elaborate slightly.

The Visa request for my SO's mother and niece is for only a temporary stay. No more than 90 days as was listed in my letter to the American Consulate. I listed that I was going to provide all support and housing during their stay. Not sure what her financial status would be. Her husband passed away about 5 years ago. She still retains the family house in Fushun. She doesn't work but lives off his pension and has five daughters and one son (all married) that provide additional help to her.

For 9 you will list your wife.

For 10 you will list your wife again.

You don't list mother or niece on line 9 or 10, you are not filing a visa petition for them to USCIS, you are not applying for their visitor's visas, THEY are applying for their own visas at the consulate.

OK, I just picked up my wife from work so I could ask her some questions. i've somehow convaluted the question somewhat. Her mother has intentions to provide means of support and documents on her home in China. Aparently she is financially stable and will have no problem providing them with what they require. But my wife is informing me to fill out the I-134, Affidavit of Support for her mother. my wife says from reading from other chinese girls in America that this is required for her mother when she goes to the American consulate.

So here i am I'm only slightly informed of the process from my wife. And she can't communicate good enough in English to ask these questions. Now my final thought. If I provide my wife's mother with an I-134, I have no problem with this, whether she needs it or not, i feel it's better to be prepared if they ask. My wife says that her mother has a large pack of papers that she has prepared when she goes to the American consulate. Probable to satisfy the questions that she plans to return to China.

So with all that said, the question that I originally asked needs an answer. Now I think that question 9 and 10 is asking me if I have ever filed an I-134 affidavit of support and a visa petition on behalf of another person is refering to my SO. Is this true?
