how J-1 holders change status by marriage ??

Hi guys, (L)

May i ask some advice ??? I come to USA by J-1 visa since last June 05 and it will exp in June 06. I will married . Now I 'm preparing to change my status and I am not sure what kind of form that i need to fill in ?? I know some of them...

I am sure that i need to fill these ...

1. I-485 Application to register permanent resident or AOS )

2. I-765 Application for Employment Authorization ( optional )

3. I-131 Application for Travel documents ( optional )

4. I-864 Affidavil of Support

*** But i am not sure about these form .. so do i need to prepare this kind of form ?? ******

5. I-693 Medical Examination of Aliens

6. I-130 Petition for Alien relative

7. G-325A Biographic Information

If i misunderstood ..Please give me some advice :help:

hi kittythai,

before you can file for adjustment, you have to determine if you are subject to the 2 year home residence requirement as you are on a J1 visa. if you are, then you need to fulfill this requirement, or get a waiver of this requirement prior to filing for adjustment (I-485). if you are not subject to the requirement, then you can file for adjustment.

As the previous poster mentioned first you have to check if your country is one of those that have a 2 year home residency requirement. If you are clear from that requirement you may file AOS. All the forms you listed are required:

1. I-485 Application to register permanent resident or AOS )

2. I-765 Application for Employment Authorization ( optional )

3. I-131 Application for Travel documents ( optional )

4. I-864 Affidavit of Support

5. I-693 Medical Examination of Aliens

6. I-130 Petition for Alien relative

7. G-325A Biographic Information

I think this form needs to be filled out by USC and by foreign spouse.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

Yes: I-485 needs the I-693.

I-485 can not be considered without I-130.

I-130 requires G-325a (multiple) & so does I-485?
