I have tried to search for the answer for this one and I am hoping that someone can help me out.

I Have everything done, but two ways .. depending on the answer.

On the first page of the T1 General do what do I put as his net income for 2007 if my husband (the american) did not make any Canadian income, but made money from his American job?

On the same aspect, on scheduled 1 you can claim a "spouse or common-law partner amount of $9,600", so since he did not claim it, can i? or because he was in the USA the whole time maybe neither of us can?

Any help is GREATly appericated.

Feb 5 - lawyer sent in i 130 application.

march 28 -got the I-797 Notice of action for I 129F

May 8 - they sent 797 notice of action -a sking for information

June 20 - I 130 approved

July 31 - Fees paid and 168 affidavit of support sent

October 6 - They request more information - for CR1

October 18 - lawyer sent to them

November 2 case completed from NVC

November 16 - congressman calls - waiting for interview date

December 12 - congressman calls - interview has been set

Jan 29 INTERVIEW IN MONTREAL!!!

Missing some steps.. but getting there :)

Im no tax expert!!

So ur USA spouse has resided in the USA (never in Canada) right?

If thats the case, filing ur Canadian taxes is just like your SINGLE!! U get no deductions or credits for ur American spouse!!

BUT if ur using tax software,one has to "fool" the program (at least I had to, maybe not in the new programs!) So for his SIN, since he doesnt have one, i just put in all ZEROS, and for his income, I just converted my wifes into Cdn $$, I just did that to fool the program to ensure I didn't get any deductions or credits. If your doing it by hand, leave it blank. As wel ensure you put in the date you ceased to be a Cdn resident as their are some calculations the software makes that are prorated.

Its pretty straight forward,even though ur married, ur in a way filing as ur single!! I included a cover letter stating my USA spouse never resided, nor worked in Canada.

If you have RRSP's,when it comes time to file for the IRS, one has to fill out form 8891. This just notifies the IRS that you have them, and they wont tax you on them now. BUT your State may stil tax you on them, each State has different rules!! As well you have to inform ur Cdn financial institution that holds the RRSPs that ur now a non resident of Canada, and they wil mail u some forms to sign!! blah blah blah!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Have I said how amazing you are!

I thought as much, but it would have made a difference of around $1,500 if I could have claimed him as a dependant!!! Oh well, I still get a credit, so it's all good.
