Hi All,

Im applying for K1 visa and they have chashed cheque.

I read somewhere that if youve had a J1 visa, you could be subject to a 2 yr homestay. I had a J1 both in 2006 and 2007 and had no problems getting them. If the homestay applied to me i wouldnt be ablt to get one for 2007 would I?

I went over fo a job as camp counsellor so it wasnt governemnt funded or medical training so i dont think it does apply but how do i know for 100%, does any1 know any sites or have more information?

ouf.... j1 you have to wait 2 yrs i think before applying for the k1

i think a waiver exist ... probably more knowledgable people can give details

There's a few other ways you can check.

Look in your passport and see if there is a stamp or notation on the J1 regarding the two-year home residency requirement.

Or....look at any paperwork you received for those visas. There could be a notation on that paperwork.

From the sounds of it, I don't believe you are subject to the restriction. But you should be vigilant in your efforts to ascertain that for yourself.

do not have to worry about it because K-1 is something you are applying for marriage basicly and there is no way you will have a problem what happened in the past ..everything will be ok ..

this advice is definitely not applicable. A J1 with a home residency requirement will either have to wait out that time span or apply for a waiver. A K1 won't make it go away.

Ok thanks.

I think ive actually found the answer myself. It was only a camp that i worked out and therfore want medical training, specialised skills or at a governemnt agency so i Think ill be ok. Just emailed my employer to be sure....

any more advixe would be great tho :)

the 2 year rule applies to you only if you've been sponsored by your government, so don't worrie.

This is untrue as well. There are other circumstances in which the two year home residency requirement is required other than governement sponsered visas.

This condition, as well as other restrictions, are listed on page two of the DS-2019 and should have been explained to you when you signed for the visa. As Rebecca stated above, it should also be listed in your passport where the visa is stamped. Your best bet is to check your paperwork and, if required, you will need to file for a waiver.

On my husbands, there was a place where they could check if he was required to complete the 2 year requirement. His wasn't and he wasn't :)

Stuck in FBI name checks...

Got the GC July '08
