K3 need fingerprints for EAD?

Hello,

I am in the US on a K3 visa and I just applied for my EAD 4 days ago. My lawyer gave me a list of everything I need to put in the package and I sent it off. Well, he never told me to put in a money order for $70 for the fingerprinting because he told me I had them taken at my K3 interview.

I was wondering if this is true or are they going to send my application back and I have to add the money order then send it again?

Also, has anyone ever had their application sent back? How long did it take?

My guess is that you didn't need to include the $70 biometrics fee with your I-765.

Have you, or will you be, applying for adjustment of status?

wel I juust went back to the uscis site and looked up the answer.. its clearly stated on the I765 app that the fee must be paid. Its there on the first page of the document:

180 base fee, plus $70 biometrics services fee if you have not already been fingerprinted for another immigration benefit. also even if she has filed for AOS if the forms werent filed together then you have to pay for 2 biometrics.. that info is per a uscis operator.. I know they are notorious for misinformation and thats why I called 3 times and got the same answer each time.

When I sent off the forms for my EAD i included a seperate cheque for the biometrics, the cheque was returned to me uncashed and I wasnt asked for any payment when I actually went to the office to have it all done.

Yes I will be applying to adjust my status however we need to wait until we have more money for that so probably a month or so.

I did read the directions where it said "include $70 for biometrics if you haven't had them taken before" on the I-765. This is why I asked my lawyer if I needed to include it. He said no because I did have them done with my K3.

I was just wondering what other people had done and if my lawyer was right. I guess I will find out in a couple weeks if they send my package back or send out the NOA.

Hi Terry....Glad to see that you made it....I think you were there picking up your Visa when I was leaving the office on the 21st????

Just wondering why your lawyer said you had them taken at your K-3 interview???? Im doing the AOS (DORA)and had to pay the $70.00 Bio fee because we didnt have fingerprints taken in Montreal the day of our interview.....

26-June-2006- Social Security# arrived in the mail....YAY!!

xactly, no fee for K3ers. It's included in the 180$. It's confusing, I paid it and they sent back the check for bios.

Jkage, yeah I must have missed you in Montreal. Yep I did have fingerprints taken at the interview when I went into the second room.

My K3 wife did the same thing - applied for employment authorization before applying for adjustment of status. She did not pay a $70 biometrics fee with her EA application.

Why that mention of the $70 biometrics fee is on the I-765 information page is a mystery to me. For one thing, the use of the term "biometrics" and the phrase "biomterics services fee" seems inappropriate. The photo and full set of fingerprints taken for AOS is true 'biometrics', the photo and print are captured and stored for use with ID recognition computer software. It is 'high tech' and the fee is appropriate to cover the cost. But the photo and fingerprint taken for the EA application are used simply for the EAD card - nothing 'high-tech' about it, nothing to justify a $70 fee.

Did they scan all of your fingers or just your pointer fingers on both hands???I cant remember how many of mine they scanned Im thinking it was only my pointer finger thou...damn nerves Its a wonder I could even remember my name after that day.....hehe

Hello!! I also applied for my EAD before than my AOS. I didn't pay for my fingerprinters either, I did pay for my AOS.

I received my NOA yesterday and it said they are processing my application and that I will be sent a date for my biometrics. I guess the $70 fee is included in the $180. Thanks for your help!

I have another question. I read that if you don't have the EAD by 90 days you can make an infopass appointment and get one from the local office. Does the 90 days start from the receipt date on the NOA or the notice date? The letter says they received my application May 3rd but they sent out the notice May 8th. So if I don't happen to get my EAD can I make an infopass appointment for Aug. 3rd or 8th?

One more question lol. It said in my letter that it normally takes 60-180 days to process this type of application after my biometrics appointment. As I said before, I thought it was 90 days from the date you apply. Can anyone explain this?

Good question as to when the 90 days starts. At some offices it's the application Receipt Date, but at some offices they start counting from the ASC appointment date.

The processing time estimate is meaningless. Ignore it.
