Hello everyone!

I have a quick question when filing for the I-485 --as we are a little late in doing so. We got married in February....and are getting ready to send out Pete's AOS/I-485. His K1 expires in May.

When I'm making the check out for the I-485, does the $1010.00 include the biometrics also? I know it includes the advance parole and EAD, but I wasn't sure if that's the total balance or not.

13 April 2007--Mailed I-129F (Processed at California Service Center)

18 April 2007--Received NOA1

13 Aug. 2007--Received NOA2

09 Oct. 2007--Medical in London

08 Nov. 2007--Visa Interview & Approved

14 Nov. 2007--Pete receives K1 visa in the mail

21 Nov. 2007-- Pete arrives in the United States (together at last!!)

27 Dec. 2007--Our 3 year anniversary of being engaged

16 Feb. 2008--We were married!!

Yes the total amout including Biometrics and EAD and AP is $1010.00...

There is no time limit for filling the AOS... so you are not late in filling...

The K1 is a one use visa, so it essentially expires the minute you enter the US. However, you must marry within 90 days of entry to the US.

There is no time limit for filing AOS, but once your I-94 expires, you are technically out of status in the US and therefore should not leave the US until the AOS is complete, or at least AP is approved.

Ops, I guess that does not really matter..I mean, if someone put the date stamped on the I-94 and already have the permanent resident status...is ok. But I just call now to USCIS and they was pretty clear...the date of expire Visa is 6 months after issue..is this what they ask in the form for AOS...

anyways...

I decided to put the 6 months.

I-485 does not ask for your visa expiration date, it asks for your Current USCIS Status expiration date. Once you enter with a K-1, your status is K-1 Visa Holder. That status expires 90 days from entry into the US (i.e the date stamped on the I-94).

The expiration date of your K-1 visa is something totally different, it's date up to which you can use the visa. It is not connected to your status. If you entered the US on the day before your visa expired, your Current USCIS Status expiry date would still be 90 days after you entered, not the expiration date of the visa.
