Hello,

I got everything ready for my AOS except the Affidative of support since my wife and I don't make the requirement since we are students.

are we supposed to fill the i864 A or the I864? my brother in law mad 80 000 $ last year. He's in the marines right now but he didn't make enough last year does he qualify??

Are we supposed to have 2 forms: i864 and i864 a??

US Citizen spouse MUST fill out I-864, because even though they may not make enough to sponsor, they are still the primary sponsor. Brother will be Joint sponsor, and will also provide an I-864.

I-864A is only used for cases where a household member may be providing additional financial support to bring a primary or joint sponsor up to income povertyline.

An Example of when I-864A is used, is K-3 visa adjusting status, The K-3 holder can get EAD and a job before filing AOS, and then the K-3 could use the I-864A to in part self sponsor. The US Citizen spouse provides I-864, and the K-3 foreign spouse would provide I-864A.

oh thank you !!!! so we won't need the i864 A. wish us good luck for finding someone, I'm scared of asking my boss, and the problem is that all the peple are scared of doing that paper. My wife aunty is not even picking up our calls anymore. it's sooooo sad we are calling all her family ,...
