Timeline

Hi everyone,

I moved down to the states on a K-1 Visa in February. We have since gotten married and are about to file the AOS within the next couple of weeks. We also recently moved into a new home and I'm trying to figure out how to change my address with the USCIS. I was doing the online AR-11 and the first thing it is asking me is, "I am in the US as a... Permanent Resident, Student, Visitor, Other" I'm not sure what to select. What is my current status, if I have not yet applied for the AOS and I came to the US with a K-1? If I choose "Other" it wants me to explain. Please help!

One other thing... at the end of the form it says "If not a permanent resident my stay in the US expires on," what do I put here? If I apply for AOS a month or two after I was married, and I am waiting for it, what is my status? I'm totally confused.

It is my understanding that you do not have to change your address until you are a Permanent Resident. Just file the AOS with your current address. :thumbs:

As for as status is concerned, after you arrive in the USA for 90 days your status is "K1 visa holder". After filing for AOS, the status is "AOS pending". In between (after marriage but before you file AOS) you are legal but technically "out of status".

Nov 24, 2010: Did SSN and Applied for Passport
Dec 6, 2010: Passport Arrives
Dec 7, 2010: Sent for Indian Passport Surrender Certificate
Dec 27, 2010: Surrender Certificate Arrives
Jan 3, 2011: Sent for Overseas Citizenship of India Card
March 1, 2011: Received OCI card!

Divorce

Feb 2015:​ Found out he was cheating (prostitutes / escorts)

EVERY immigrant in the US is required to notify USCIS of any address change, whether or not they are a legal permanent resident. Also, their sponsor/spouse is required to notify USCIS of any address change by using form I-865. Even if they haven't yet done an I-864. They consider the I-134 affidavit of support the same thing.

What form does the spouse use to change the address? Same online one, or do they send in a paper form?
