Hello,

I'm new to the site and I'm trying to figure out if I'm even eligible to apply as the petitioner of a K1 visa. I just started my current job 2 months ago, make good money. But before that I was unemployed (by choice) for almost 18 months. I am not filing any income for 2007. But I have income for 2006. Do I meet the requirements?

There are NO employment requirements to file an I-129F petition for a K-Visa.

This comes much later when you need to show support to the consulate, when your fiancee interviews for the visa, only at that time will you have to show that you can provide support for the prospective immigrant.

:no: NO. USCIS does not look at the petitioner's employment history when adjudicating an I-129F

There are thousands of people who do not meet the financial requirements - they get a co-sponsor like a family member or close friend etc. Do some reading on poverty level and co-sponsors on this forum and you will learn a lot and would be ready when the time comes. Good Luck

Thanks guys... but I guess what I was really wondering is can I do this without another sponsor. Since I will have no tax returns for 2007 to show the consulate with the I-134 form and only a few months of current employment, will that be enough?

Most consulates will want to see past year's return even if it was for very little, you can file a ZERO return for 2007, and provide an employer letter and many recent pay stubs showing current income is enough to satisfy the requirements of support.

Please fill in profile details, knowing which country you are dealing with helps members tell you what to expect, consulates in different countries behave differently with respect to affidavit of support.
