hello VJers,

Please enlighten me of what are the possible steps or things to do to our situation now.

We are in the middle of our K1 process. It just so happened that I failed my medical exam last Feb. and therefore waiting for another 2 mos until everything turn out right and get another date of interview.

But suddenly my fiancee got a job in middle east.opportunity only knock once and he really need to grab it.

So for now we do not know what to do next. do we have to abandon the petition and just inform that he moved to another country? who is to inform? the USCIS or the USEM?

Right now the plan is for us to be with him in Middle east also. Can we get married here in Phil. so we can join him in Kuwait?

what about if the time comes and we all want to go back to US, do i have to come back to Phil. for the another process again? BTW, hes not military.

Oh please, anyone who know or experience this kind of situation.

We really have to know the legal steps since we have our petition almost there already.

Ill wait for an answer...

i would take in consideration a few things....

1 - wait whatever it needs for the medical up to the time you will get your visa (do not interrupt anything, everything is good and people moving country for work is common)

1b - once your futur husband will have an adress in koweit, call the embassy in philippines to tell them his new adress anyway

2 - a k1 is valid for a marriage inside US and for ONE entry (i guess within the US can mean US islands (wich might be closer to koweit ??) double check about it.

3 - so obviously you will both need to go back there to marry (you can do it at like las vegas on a week end)

4 - in order to leave the country (US) (for example to go in koweit) and be able to come back, you need to wait to have the advance parole

5 - so fill your AOS, EAD, AP, SSN and wait inside the US (i guess alone) for something that can take up to 3 months (and sometime more if problems)

6 - you join your hubby in koweit or.... if you have a good support network, you stay in US, start adapting there, start working and go visit him every once in a while.

I would strongly suggest to ask the embassy in philippines about your situation aswell as the USCIS.

Because there can be something specific on your case like for example if you do not live within US more than 6 months a year or so... you might loose your temp. status (GC) except if perhaps you fill the form XXX and XXX (this is an exemple, i don't know how it works). Get the more info you can !

we are still here in the Philippines.

My fiance is moving there already on the end of this month so even before the result of the medical be release he is already in Kuwait.

So my question is do we have to continue the process of the K1. Like i said he willbe in Kuwait already.

yes, you can continue to do the K1. if you want the short answer.

You do not need him to finish it.

as if.... you HAVE TO.... that depends on you both but it will be stupid not to finish it.

as i said, you will have to marry in US territories and you the non USC fiancee will have to stay within US to adjust all status before you can go join him wherever he is.

Take a lots of info from the embassy and the USCIS since your case is specific.

after your AOS, AP, EAD, SSN will be done, you will probably be able to join him and to come back to live in the US no problems
