I have a question about the I-864 affidavit of support form.

I am william_wallace's fiance here in the uk with him for a visit ....an american citizen who will be sponsoring him along with my parents. I do not have suffient income from the last 3 yrs to do this on my own havin went through a divorce a little of 2 yrs ago i am just gettin on my feet these last 6 months...I am well over the 125% poverity leval as of now but was told that I need at the min. 2 yrs of consistant work history to sponsor on my own..hence gettting my mom and dad to help me out with this...

After reading through some of the affadavit support forms i came upon this statement below.

"IF you do not provide sufficient support to the person who becomes a permanent resident based on form I-864 that you sighed, that person may sue you for support.

If a federal, state or local agency, or private agency provides any covered means-tested public benefit to the person that becomes a permanent resident based on form I-864 that you signed, that agency may ask you to reimburse them for the amount of benefit you provided. If you do not make the reimbursement, the agency may sue you for the amount they believe you owe.

If you are sued, the court enters a judgement against you, the person or agency that sued you may use any leagally premitted procedures for enforcing or collecting the judgement. You may also be required to pay the cost of collection, including attorney fees."

...what my question is how liable will my parents be for helping out and signing these forms? or will the main burden be on me?

Also what happens say for instance there is an accident and me or my soon to be husband gets hurt or gravly ill what benefits are you entittled to apply for without penalty?

Or you are let go from a job for no reason of your own doing...can he collect unemployment benefits without penalty?

And what would be concidered sufficient support?

i know this is a bit long winded but I know as my parents are wealthy they will take issue with some of the wording in the I-864 form and will not like the fact that they may or could be held liable for 5 yrs?

And are there any other options available for me as a means of sponsoring my fiance without the help of a joint sponsor as I am well above the 125% just not for the allowable time?

Also and lastly i read that you have to have 3 yrs income tax forms... well 3 yrs back would put me with my x husband would they still want those and if so would they be admissable?

I'm not sure about the other, but I think I remember reading that they only need your most recent tax return. I could be wrong, though. I hope I'm not. I don't HAVE my return from three years back, only two.

If you're in K1 process you don't need the I864, this is only when you/your fiance will be adjusting status in US. The correct affidavit is I134. If the petitioner (US citizen) doesn't meet the poverty guidelines 125% in the last year of the income tax. You can use a co-sponsor who meet the poverty guidelines. If you meet the poverty level in your last year of income tax (2007 or 2006) you can only send it. The other last two are optional but instead of these you can attach a letter where you explain why you don't have the income from other years. Also you can attach evidence to support that statement (like school records). Hope this help you.
