My husband filed for AOS via DORA almost a year ago and it was denied 3 months ago. We've been on top of it the whole way, calling the 800 number, going to the field office every couple of months, getting our congressman, senator, and attorney involved. USCIS says the case was denied for lack of response to an RFE. We never got the RFE. We cant get anyone to tell us what the RFE was for. I even filed a motion to reopen and they rejected it. So Im really thinking refiling is the only way we're going to get anywhere. My husband has no EAD, no SSN, no travel waiver, no green card, no nothing. Trouble with refiling is we dont have all the pieces to file with anymore. His I-94 was taken at the interview when we originally filed. Plus, Ive been on maternity leave since December with no income, so I cant really redo the affidavit of support. The problems abound. Has anyone ever refiled for AOS?

What has your lawyer said about all of this? How did your husband enter the country? on what type of visa?

I havent consulted the lawyer about refiling, only about trying to get USCIS to fix the original case. Hubster wants to pour more money into the lawyer and make him fix it. I dont think its worthwhile, hence I have not consulted him. Hubster came in on a K-1 via Chicago in February of last year. We've had major problems ever since he entered the country because not only did CBP fail to register him for NSEERS, but they also entered his DOB as 1928.
