Hi there,

As I am just now filling out the application for a K1 VISA for my Guatemalan fiance, I have some concerns over what happens when (crossing my fingers already!!!) he receives his VISA and we are married in the States... I understand that it is a couple years before he is considered a permanant resident. I want to make sure that I am applying for the right VISA, and be certain that we will still be able to travel to Guatemala...

If we choose to return back to Guatemala in the period following our marriage, what are the limitations to the amount of time we may spend out of the USA?

How easy is it to be granted permission to leave for Guatemala and return, and does it make a difference if we are travelling together?

Upon arrival the K-1 is used and is now considered VOID, the POE will issue a 90 day I-94 card.

Mary within the 90 days, and then file to adjust status, also file for work permit, and Advance Parole (AP). AP will allow travel out of and return to the USA.

Green-card from K-1 can take a few months to over a year. Ours took 4 months from AOS filing to getting the card.

This is a very frequent question.

5.12)...Is it okay for us to go to the US Virgin Islands or Puerto Rico on our honeymoon without Advance Parole?

5.12.1)...What about visiting Canada or Mexico prior to filing for Adjustment of Status?

Makes no difference if traveling together or NOT.
