Deadline for K-1 (packet 3) application return to Embassy

Hello Everyone,

I have had a smooth sailing so far...but now I have a snag, but it is not with the Embassy. My fiance' got her Packet 3 from the Brazilian Embassy in January, but because of property settlement issues she won't be able to leave for the US until October of this year. She has yet to apply for the K-1 visa, we thought we would wait for a few months until she applies, so that October will fall within the 6 month window, after visa issuance, that she need to leave for the US. The questions is can she wait 4 or 5 months before she applies for the K-1 Visa...does it expire? I would hate to start this whole process with the INS here in the US again. Or should she just apply and then advise the Visa Office of her desire to leave later in October. Please advise, I just don't know which way to proceed.

I actually have the same problem. I have not gathered all my documents yet and one of my police certificates will only arrive in three months time and I am expecting my Packet 3 this week, as promised by the embassy. Worried about the delay to return my checklist, I wrote to the embassy and they told me this:

"There is no time period to submit the checklist but you have to do it immediately after gathering all your required documents."

Therefore I suggest that you should let the embassy know of your situation and apply for extension of your NoA 2. NoA 2 has four months of validity.

We received the NOA2 notice December 14th, so that would imply that my fiancé' would have to return the packet 3 forms (required forms + copy of Passport) back to the Embassy by April 14th. That would work, then they would schedule for an interview, at which time we can request for an delay in entry.

On the other hand it would be better to ask for an extension of the NOA2 from April14 say September 14th. Has anyone here requested for an extension of the NOA2. Would like to know how that process went. Any advise is greatly appreciated. thanks CG.
