Nearly twenty years ago, whilst much younger - dumber....I filed for a fiance visa...and the whole affair ended miserably...she left almost immediatly (former Soviet Union) and she (apparently) went thru a lot of different stratagies to change her status. The (then) INS contacted me, and asked me of her alligations, all of which I dispelled. She ended up getting PG with another, and managed to remain in US (I did'nt care) I was told then that I was no longer needing concern of and about her. Jump ahead ten years later..I marry a lady from northern China. After almost five years, she and I split the sheets. Now, three years later, I meet and am wanting to marry my fiance from Phils....but there is a 'multiple' (previous) filing waiver needed. I did not send one along..as I am under the belief..the first, was 'void and nill'....so that means I have only 'filed' just the last (the Chinese) meaning only one..not two (multiple).

My question....if, for whatever reason Uncle Sam demands a waiver for filing (another) fiance visa...what is the best way, and how to do so? Anyone else out there...ran across this? I realize my past dismul failures...should not hold me back...live and learn. Not only have I found the right lady..I also have the learning curve.

Would appreciate any information.

The girl from China, was it a K1? if not no waiver needed. If so then you will need a waiver. I did a K1 for a girl in China, which didn't workout after only a few months after approved. I found my true love in the Philippines and submitted my second K1, but sent my waiver with my I-129F to be proactive and it worked, no RFA sent to me just the approved NOA2.

What I did was write a letter with title of waiver request for multi K1 visa to whom it may concern. then all I did was explain why the last girl didn't work and why I belive this girl will, I also sent supporting documentation (ie, phone bills, txt message records, western union recepts) to show we are very serious for each other.

You'll need to answer all questions accurately but the waiver requirement is specific to two or more I-129F petitions approved in a two year period. The law is so poorly written, it is impossible to know on what date the two year window begins and ends.

Your information doesn't indicate whether the Chinese woman came on a fiance or spouse visa but if you are three years clear of a divorce from her, there's no way the IMBRA two year issues would apply.

Facts are cheap...knowing how to use them is precious...

I wrote the second K1 fiance visa request..in 2000. It was approved and she was here in the US in 2001. It has been what....6..almost seven years since I wrote the visa for the Chinese lady....we ended in divorce after five years of marriage. If I read this ruling right...it says "two or more K1 fiance visas...in a TWO year period..." Is this the case?? The last visa I wrote was 2000..and now, I, like you have found a real gorgeous 'keeper' from Phils..and we are great together. I should have gotten smart...years ago..and just went to Philippines...!

I am hopeful, I will fit in the "no more than two in a two year period clause".

Thoughts??
