Timeline

I've been on this site so many times reading and researching every step of the I-129F/K-1 Visa and every time it ends with me just getting stressed and not knowing much more then when I started so I figured I'd try asking some questions on here.

1. I haven't ever had a job so I haven't filed any taxes and up until 2007 I was filed as a dependent on my parents taxes. I don't have a job at the minute and am currently looking for work. I am confused about the co-sponsor... Will we have to live with the co-sponsor and if so for how long? is there a way to change sponsors if we do want to move out and I can support my fiance?

2. are there any restrictions on visits while the I-129F is being processed?

3. How long after marriage does it take before being able to leave the US?

4. How long until my fiance can get a drivers license?

Also I don't know much about the Green Card and citizenship. so any advise or explanation would be much appreciated.

March 16th, 2009 -- AOS Sent

May 8th, 2009 -- EAD & AP Approved (51days)

July 14th, 2009 -- AOS Approved!! (118days)

July 21st, 2009 -- Green Card Received (125days)

No RFEs the whole process :) All done myself.

December 4th - 30th, 2009 -- Visited England

April 8th - 30th, 2010 -- Damian's Brother visits us here in PA.

January 19th, 2010 -- Damian got his PA license.

December 10th - 19th, 2010 -- Visited England

September 16th - 30th, 2011 -- Damian's Parents came to visit us here in PA.

June 1st, 2011 -- Mailed ROC to Vermont.

February 21st, 2012 -- 10 Year Green Card Received

April 14th, 2012 -- N-400 Sent to Dallas Lockbox

November 26th, 2012 – Damian Became a US Citizen!!!

There is no requirement to reside with your co-sponsor for the purposes of an I-129F application. When you apply for AOS after marriage you will need to refile the affadavit of support anyway, so any change of circumstances between now and then will be allowed for as a matter of course.

2. are there any restrictions on visits while the I-129F is being processed?

There is always a possibility that your fiance can be denied at the POE, however I visited my fiance in the US 3 times last year without a problem. Your fiance should not stay for longer than 90 days on the VWP (no more than 180 days any one 12 month period) and should show ties to his home country e.g. proof of ongoing employment, utility bills, rent/mortgage agreement etc.

3. How long after marriage does it take before being able to leave the US?

When you file for AOS the fee now includes Advance Parole and EAD (however, you still need to fill out the forms for all seperately). This typically takes around 3 months although it can take longer. In an emergency you can expedite the AP.

Hope this helps, I've basically answered the ones I am pretty sure on. I'm sure other posters will correct me or help with the questions I left out. Also try using the forum search for any additional information, these are common questions.

It seems like a stressful process, but many people are in a similar situation and have successfully filed for the K1 visa. Good luck!

1. If you don't meet the poverty guidelines, you will have to have a co-sponsor

2. your fiance will have to file for AP to travel abroad

3. As long as your fiance has AP he can leave, when a greencard has been issued, he can go anywhere

4. he can apply for dl at anytime, just bring original documents that shows he has residence in your state, I think we had to supply 3 items. each state is different though.

Hello!

Here is my knowledge/opinion on your questions:

1. You do NOT have to live with the sponsor. however.. this process is pretty financially burdensome. If you haven't worked at all or dont have an income source you have to find an alternative way to pay for processing fees, travel expense, moving expense.. plus there will be a period of time when your fiance wont be able to work legally so you will have to have the funds to support them or they will have to have enough money in the first place to support themselves.

2. There are no specific restrictions however it is harder for the fiance to come into the US to visit. Immigration sees that they have a fiance petition pending, and they may be skeptical about your fiance's intentions of entering the US. They may feel your fiance is coming to stay permanently ... and at their discretion may send them right back home. If they are coming to the US they should bring anything they can proving ties to their home and intention upon returning such as a letter from their employer stating that they are to come back to work after the trip or a lease to an apartment that they have signed. It is much better for you to go to the foreign country to visit. you will have little to no difficulty in doing so.

3. That's a tricky one. it depends on how quickly you file for Adjustment of Status and Advanced Parole, how quickly these are processed, and if they are approved.

4. That i don't know.

EAD Approval was NOT updated online. We had an infopass meeting for 3/6 and then the EAD shows up in the mail on 3/5!!!! cancelled appointment,

all i have to say is #######.

Try not to get stressed out because it will not get you anywhere. Just sitback and relax and take things one at a time. It really isn't too difficult due to all the help you have from this website.

i hope this helps.

Some states will honour the foreign license, some won't. Here in GA my husband was told he had to have his EA card in hand OR his green card. Without one or the other, no license. If he had used his I-94 to get his license it would have been a temporary thing, expiring when the I-94 expires. The OP should check with the DMV in the state she lives in for their requirements.
