Dear All,

I'm just wondering if the approved I-130 petition is in NVC, will it delay the AOS process?! Okay, All the K-3 visa holder might remember that there is another option to AOS, and that is Consular Process. The K-3 can have their approved I -130 sent to the U.S. Embassy or Consulate abroad and then travel to meet it and have their immigrant visa interview and process. They return to the U.S. with an Immigrant visa (IR or CR visa), not the K-3.

Anyway, we chose AOS like the most K-3 couple because nobody knows if you can return to U.S. when you don't get the CR (IR) visa right away or denied or put on AP. Embassy might even cancel your K- 3...some people say.

Anyway, my wife finally entered the U.S. with K- 3, but at that time the approved I- 130 is in NVC already! I remember at that time, I have paid the I -864 bill and was hanging on the IV bill and DS-230 and didn't send it to NVC....

Most people think and say that, "Once you file for AOS in U.S.; the USCIS will request your approved I-130 petition from NVC." "The NVC then will release the I -130 to whatever service center your I-485 is at." I remember a lot of people here say that THIS MIGHT CAUSE SOME DELAY FOR RECEIVING GREENCARD. So does anybody know anything about this? Or has any info to share?

But there is really no proof or a significant fact to show the above statement was correct. I remember under the discussion "AOS vs. Consular Processing" here, there is a legendary member called "Classic." This guy received the Green card 1 week after the interview when his I -130 not only has completed in NVC but also had been sent to the U.S. Embassy abroad and had an interview date showing! Of course, this couple didn't go to the immigrant visa interview abroad.

So we really don't know for sure if it would delay AOS process if the I -130 is in NVC. It looks like a lot of couples have received the GC in 2 weeks right after the AOS interview. USCIS doesn't even mail out the Welcome to the U.S. Letter like they used to. I even wonder if they bother to ask NVC to release the approved I -130 for them to take a look before they give you the green card. Does anybody know anything about this? Any info is appreciated!! Sep 13, 2005 - I-130's approved, petition forwarded to NVC

Oct 10, 2005 - I-864 Bill received by agent

Oct 12, 2005 - Paid I-864 Bill by Postal Money Order-$70 for whole family

Dec 17, 2005- checklist for I-864 received, reply sent back & entered into system on Dec 22.

Oct 20, 2005 - Alien spouse received DS-3032 (Choice of Agent) documents

Oct 24,2005 - DS-3032 sent to NVC (fr Phils)

Nov 17, 2005 - IV Fee Bill paid by Money Order & sent

Jan 3, 2006 - Mailed DS-230 to NVC

Jan 4, 2006 - DS-230 entered into system

Jan 12, 2006 - CASE COMPLETED, and still waiting!!!

Sep 10, 2005 - NOA-1 for I-129F

Oct 19, 2005 - I-129F Approved (email notice), received mail Oct. 28

Nov 2, 2005- Received K3 approval notice

Mar 24, 2006 - K3 interview

Apr 4, 2006 - Visas in hand

May 8, 2006 - arrived in America

AOS

August 2006 - mailed I-485 forms

September 2006 - Biometrics done

December 2006 - Interview; Green Card received by mail a week later

2007: Applied for kids' certificate of citizenship, got the certificates in June & passports in August 2007

07/05/07 - Went back to US Embassy submitted new affidavit of support for my K3, we'll wait for decision, still on AR

07/24/07 - OMG!!!! I cant believe it I got my K3 Visa in hand!!!

08/09/07 - Arrival in the U.S - POE at LAX

08/27/07 - Sent AOS and EAD

08/29/07 - Chicago Lockbox received both AOS and EAD

09/18/07 - Checks cashed 09/21/07 - NOA on both AOS and EAD

09/27/07 - Received Biometrics Appointment Notice

10/18/07 - Biometrics

10/19/07 - Received RFE

10/26/07 - USCIS received the response to our RFE

11/05/07 - EAD Card Production ordered

11/16/07 - EAD Card received

11/26/07 - Received interview notice

01/25/08 - Interview Date!!!! APPROVED!!!

04/18/08 - At long last! GC Card production ordered

04/21/08 - Email noticed welcome letter

04/23/08 - Email card production again

04/25/08 - Welcome Letter received

04/30/08 - Greencard received
