Proof of marital status

Hi everyone!

This might be country specific but I will still ask in hope someone has advice. Ok so I need a birth certificate for my K1 interview, but before I can get one here in Croatia, I need one from my American fiance along with a proof that he is single. (or stating his marital status) Does anyone know where he would get that, would that be indicated on his birth certificate itself or would that be some kind of certificate?

I`m confused, why would you need that?

I just got my birth certificate for the interview, and it isn`t connected to your US fiance birth certificate and/ or marital status proof....

package 3 doesn`t mention it, nor did the Embassy when I called....

one tip: for Croatian documents, if you want them to be valid for AOS later, you need to get international verification for both birth certificate, and both police certificates before you translate them

thanks Ivona, not sure what this is all about but I called to inquire about getting my birth certificate and was told that if this was for the purpose of getting married abroad, the procedure of getting it is slightly different and I would need his birth certificate, his proof of citizenship and proof that he is not married in order to get mine?

How do you get international certification? I appreciate any advice on this:)

I think they probably missunderstood and thought that you wish to marry a foreign citizen here.... I honestly, never heard of that but that`s what it looks like, becuase to get the K1 visa (out of these sort of documents) you only need your birth certificate and the two police certificates, and the affidavit from your fiance side...that`s what the package 3 checklist states

and I called the Embassy about the translation and the verification, and not once did they mention that I might need some special sort of birth certificate....

for the international verification, it depends on the city: the verification of the police certificate from the local court- you get at the local court.....for birth certificate, and the police certificate from the ministry you go the the municipal court (for Zagreb, not sure about other cities)....

you show up with the original, one copy, and 50 kn state stamps, ask for an "apostil" and you get it in matter of minutes.....

If your fiance has not been married before, then there is nothing to prove as far as marital status. If he HAS been married before, he needs to prove that the marriage was legally terminated (divorce, annullment, or death of spouse).

What strange questions. :unsure: Isn't it usual for the beneficiary to be responsible for obtaining their own birth certificate?

in the I-129F package yes, the petitioner needs to provide proof Tracy mentioned, this is however different- this is when Lidija is getting her birth certificate here, in Croatia, and for that she doesn`t need any of those things.....

like I said, to me it seems more like papers they would ask if a Croatian citizen would be marrying a foreign citizen here, in Croatia....in the case, were marriage happens outside Croatia you would only require the normal birth certificate since you only need it as a document to present at K1 interview, and later in the AOS

According to tina 21, a VJ member whose fiance just recently got his visa in Zagreb- now although he is a Bosnian citizen and not a Croatian one, the "rules" that apply seem to be fairly consistent, and he needed his normal birth certificate and no marital status proof from her to be able to get it issued.

Be at peace hon, I really think it was a misunderstanding- apparently very common for administration no matter where you go :P

Hey all! I couldn't log on for a while cause of work so it was an interesting read this morning ! Can't believe some of the comments made, seriously, people shouldn't post unless they actually have something relevant to say.. moral lectures really don't count as that..

to everyone that actually addressed my question, thanks a bunch! You were definitely right. my fiance hasn't been married before so that's why he just couldn't find a way to prove his "single" status. I got my normal birth certificate yesterday and found out why they misinformed me last week - in case I was getting married to a EU citizen, I would indeed need this other type of b-certificate and proof of marital status. The lady didn't know this doesn't apply to the States.

Ivona, thanks for the court info, I will look into that, hope to need it all soon :)
