Some advice please!!!

Hi everyone :thumbs:

Well, I am due to file my I-751 in August 08 but I was wondering if I could file it and then leave the country for a while (not longer than 6 months) as my husband, son and I would love to spend some time in England with my family. I am in California so obviously would be using the CSC. Is there a chance of me needing an interview or biometics?? I glanced at the info provided but would just like some info from you guys who've been through this. We have plenty of evidence such as our son being born in May, joint bank accounts, lease, affidavits from friends...... We really need to go back this summer for family reasons - I'm not just trying to be difficult by leaving at this time :blush:

Any advice, opinions are greatly appreciated :yes:

11/13/2006 GREEN CARD RECEIVED - NO MISTAKES!!!!

06/06/08 Family moved back to UK!!

Husband gained UK citizenship September 2015

10/31/2016 Embassy interview

You don't have to file in August -- that's just when your 90-day window for filing opens. You can put off filing until just before your Nov. 2 green card expiration date. There might be 2-3 weeks in November where you have an expired green card without an NOA1 that shows your residency has automatically be extended for a year, but the only practical consequence of that would be an inability to travel outside of the country during this brief period.

So I would go away this summer, come back in late October and then file. There is no requirement that you file as soon as your 90-day window opens -- just that you file before your green card expires (even if it is a day before).
