I have a family member in US on H-1 and who just got married to a USC. His spouse will be filing I-130 + AOS in US.

*Could anyone tell me what is the reality of FBI name check delays these days? Has it improved in recent months or is it still a wait of 1-2 years for many?

*How can one tell one is stuck in the name check?

Yes there is still an FBI name check. How long it takes depends on the immigrants name. If the name is too close to some suspects and that the computer stops on that, then you need a manual verification, that's what takes a while.

We've seen cases of people being approved (interview or transfer) within 3 months (and you have to pass the namecheck for that) others have been waiting for years. There is no rule of time.

You can tell if you passed your interview and they tell you you are approved upon clearing the namecheck. Or if you have been transfered to CSC for a few months and nothing happens, in that case it could be an explanation but unless you talk to an IO you can't tell for sure.

08.2006: Entered with a B-2 visa.

07.06.07: Civil Wedding

07.17.2008 AOS approved with interview. It took 367 Days!

11.08.08: Big family wedding

09.18.09-10.03.09: First trip to France with Hubby

I-751

04.19.10: Package sent to Vermont

04.21.10: Delivered in Vermont

04.22.10: NOA date

04.23.10: Check cashed

05.17.10: Received biometrics appointment letter

06.07.10: Biometrics Appointment

06.26.10: Touched

07.07.10: Card Production Ordered!

07.17.10: Card in the mail :) Done until citizenship
