It is only you lot who are keeping me sane tonight, I can tell you....

Monday interview looms ever closer.

Question about the I-1864 ans I-1864A.......I am so confused!

My US spouse has a written job offer in the US but as he has not started it yet he can't use that to be my sponsor can he- he would have to have the salary showing on his bank statements?

So- assuming I'm right about that, he can not sponsor me...

it is my mother-in-law that will.

Does my husband fill out a I-1864 then?

Or is it just my m-i-l that fills out the I-864?

Or does he fill out the I-864 and she fills out the I-864A?

Or do they both fill out the I-864?!!

If she is my only sponsor, is it a problem if she is in the US, but the USC is not yet?

And does it say on the actual I-864 that it needs to be notorised?

1986-03-10 : We met in London

1986-06-30 : Got engaged! He left London to return to NY

1987-09-01 : Lived together in London while he was on student programme

1987-12-30 : Moved to Spain together

1988-06-30 : I returned to London, he returned to NY. Long distance engagement follows!

1991-05-20 : Got married in VA, US on a long weekend away!

1991-05-24 : Returned together to London to set up home here, with him on a tourist visa. Applied for residency.

1992-08-07 : He's granted indefinite right to live and work in UK.

1993-10 : Son born

1995-01 : Daughter follows.

2007-09-15 : I-130 Sent. Here begins our journey!

2007-09-18 : I-130 NOA1 recieved.

2007-11-12 : Applied to local Hampshire Constabulary for Police Certificate

2007-11-19 : Had vaccinations done by own GP- pertussis, tetanus, diptheria, mumps, rubella, measles, flu.

2007-12-17 : I-130 NOA 2 received- hooray!!

2007-12-22 : Police Certificate AND Packet 3 arrive- together!! This is quick!

2008-01-10 : Returned Packet 3 to Embassy

2008-01-29 : Packet 4 arrived

2008-02-06 : Medical at 10.30am

2008-02-11 : EMBASSY INTERVIEW!!

No he can't, it might help to prove domicile - that's about it.

Does my husband fill out a I-1864 then?

Or is it just my m-i-l that fills out the I-864?

They both fill out an I-864 - your Husband still has to be the primary sponsor. The I-864A would only apply if your Mother in Law is a household member.

"Each joint sponsor must execute a Form I-864 that is submitted in addition to the Form I-864 submitted by the petitioner or substitute sponsor. A joint sponsor does not have to be related to the petitioning or substitute sponsor, or the sponsored alien. However, a joint sponsor must otherwise meet the same requirements as a petitioning or substitute sponsor". link
