getting the runaround! advice pls...

Timeline

I am currently in the US "visiting" my hubby.

We applied for my CR/IR-1 IV in Korea when we married/lived there. It didn't get finished in time. We've now transferred the case to Montreal.

The only thing I received was a letter stating that MTL had requested my IV file from Seoul, and that I should wait for NVC to contact me. This was back in early Oct 07.

I've contacted both MTL and NVC just to check if my file has been received and to try to get an idea of when an interview would be granted. MTL told me to check with NVC, and NVC told me to check back with MTL. Grrrr.......

I have been in the US for 4 mths now just waiting on this...going to have to fly back to Canada soon, probably no interview in sight...don't know if they'll let me back in here to wait again. I am really stressing out.

Is there anything I can do from here? Extend my stay? Apply for an adjustment of status?

If you applied for a CR1 you cannot Adjust Status -- that's only for K filers. you will need to go back to Canada (please do not overstay) and continue the processing there. What's weird is them sending you in circles: someone should know where the blip your file is! Call them again!!!!

Start back at square one and contact Korea!! See if the file has been sent. I would think the file would not goto Montreal first as NVC sets the schedule for Montreal, and Montreal doesn't even know u exist until NVC assigns an interview for you. As well i would get the USA spouse to contact their congress person and get them to check into it!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
