Hi all,

I have a problem and wondering if someone can help. I submitted my AOS on Jan 11th, and got NOAs for the 16th, Afterwards had biometrics done, no touches on case though. I got an RFE yesterday for initial evidence of processing my I-485. They wanted proof, of my OPT from when I was a student. I was a student, then did OPT, and then went back to grad school. The RFE said that income earned has to be from a lawful source and while being authorized to work. I no longer have my EAD card, misplaced it somewhere (besides it was expired). I submitted income tax returns for 2006. Anyways, I sent back an I-20 which indicated my employment, my Reciept of I-797C for EAD on OPT, and Approval letter of EAD. Will that suffice? It said, i can be subject to denial. But how else can i prove it. I wrote them a letter explaining circumstance of misplacing EAD, and how I am no longer working but in school.

When i talked to someone on the phone, after they transferred me to an officer, she didn't get what I was talking about and told me submit what I have.

I hope this will be enough? Do I face denial, I didn't do anything wrong, only thing is my sponser was my wife, and we used the little income i earned to tell them that I worked. I didnt want to hide it.

June 11 2010 -- REMOVE CONDITIONS

09/12/10 Conditions Removed

He is an F-1 student and OPT is an Optional Practical Training in the area of your studies for a year (EAD).

You can apply for an OPT every two years if you earn a higher degree than before (AA-BS-MS etc...).

When you are on OPT, you do not go to school, just job full time. The only specification is that it must be a job in the area of your studies.

OP, submit what you have. It should be fine.

However, i find it weird they are requesting for I-485 and not I-765. I-765 requires proof of previously approved EAD.

Removal of Conditions on 07-19-10

In this tedious process, we tend to forget that this is all worth it.

I love my hubby beyond anything in this world.
