i heard it online here in the interviews in islamabad pakistan.im gonna to b starting the the papers for my paki husband and i need to know which papers to file k3 or k1

If he's your husband, you have to file the K3 after filing the I-130.

Not sure what you are asking. If you are the USC spouse you may petition for him. Is his mom a USC or LPR? Not sure how she could be the petitioner unless she was a LPR or USC. In that case it would be to your advantage to file Cr1/K3 for him, as spousal visas are generally quicker.

If you read in the Guides section it states that a LPR may not petition for their married son or daughter. If she is a citizen filing for her married son the wait times are longer than if you filed for him as a spouse. Again, please check out the Guides section at the top of this page.

yes, i agree, since he married, the petition his mom filed is obsolete.

He has to inform USCIS of this!

Then you have to petition for him as his wife.

It is probably also fster as spouse visas are not limited
