Hi... My wife is finally here!!! We are looking for a best option to file for AOS. I understand that we need to provide proofs of our marriage such as bank accounts, credit cards, or auto insurances that are in my and my wife's names. So, I guess, now marriage certificate and photos are not enough for them; they are looking for something for solid. So, since I can not get these more solid proofs for them until I have a SSN or ITIN (which I have to wait until tax return time to get it), what are my options? Can I apply for EAD separably form i-485? Probably not... Then what can be done? Please share your experience... I need to get SSN for my wife as soon as possible. And to do so, I need to get EAD... And to get EAD, I need to file i-485.... And to file i-485; I need to get solid proofs, which can be obtained only with a SSN, which requires a EAD, which has to be applied for concurrently with i-485.... Hhhhhrrrr!!!! A dead circle! Please help... Thanks.

Who are you referring to? Who wants an SSN as proof of marriage? I was first thinking USCIS, but you obviously haven't filed AoS yet...

And I am not speaking from experience, but I haven't seen a good reason around these forums to file EAD separately...

Only K-1 can apply for SSA within 76 days of entry. K-3 needs EAD or Green-card in order to apply for SSN.

File for EAD with AOS. EAD based on pending I-485 costs nothing. Code the EAD application (C )(9 ) and enclose it in the same envelope as the I-485.

If you file for EAD before AOS you pay $340. Based on the K-3 (Life act visa) Some K-3s do this and file for AOS later closer to 2nd wedding anniversary to get green-card approved after 2nd wedding anniversary to avoid the conditional green-card.

If you file for EAD after AOS you need to include a copy of AOS NOA1 letter to base the EAD on the pending I-485.

It is very possible that the Social Security Administration will amend their procedures and allow a K3 to obtain a SSN by simply showing proof of their status as a K3

For some reason I missed the first part of that sentence on the FAQ. Thanks Yu/Dan for correcting!

Hi anan, I was entered with K1 visa and I filed my AOS without a SSN and It will not be a problem, I have read that on this forums. If you send the AOS package this include I-485, I-131 (travel permission), I-765 (employment authorization), I-184 (affidavit) for only 1010 dlls. The marriage proofs that I sent was an bank account together and pictures, cell phone bills (family plan). When you will have your interview you will have more evidence for proof your marriage. Just file AOS EAD and AP if you want it. You dont need to include all the extra stuff for proof of a bonified marriage. Take that to the interview with you.

As YuandDan said, K3 can apply for a EAD before AOS, but with the AOS fees now including EAD and AP, it is usually better now to get the ball rolling on the whole package.
