I will make this short as possible.... As u can see by my timeline my I-130 was approved April 2006 I decided not to act on that as i was already in the states with a K3 visa.. I applied to adjust status December 2006 and with many things happening in my personal life i was traveling back and forth from England with my two sons....

My AOS was denied due to that fact i wasnt in the states and was classed as abandonment. My K3 visa has now expired December 2007 and dont know what i can do now to start the process up all over again with many personal issues being resolved.. Do i have to resubmit 3 new I-130's or is our others still valid and go through the visa centre and stay in England until it is finally at the Embassy in London... please advice i have no idea what to do next .. i emailed the NVC but as yet they havent replied.

Many Thanks

Siobhan

I-130's are valid for one year.

Although consulates can extend the life of them, I believe that's only when it expires while still being active. Meaning, if it expires before a pending interview.

Sorry, but I am sure that in their eyes you have abandoned your your I-130 approval aswell.

Makes no sense, K-3 is multi-entry visa which allows re-entry during AOS processing. I don't understand how they can deem AOS was abandoned, unless you failed to attend an AOS interview at the field office near your US residence.

Since AOS and I-130 are linked and abandoned you will probably need to re-file new I-130s

This time I highly recommend not doing K-3 and AOS, just let the I-130 get approved, and sent on to London for a real Immigrant IR-1 visa. This will get you the 10 year green card upon entry, no hassling with AOS.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.
