Hi all. Got a question on Advanced parole. What exactly is it? how long does it take to get and how long is it good for?

My fiance and I would like to have 2 weddings. One in the U.S. when she arrives (of course we have to have that). We have the U.S. wedding planned for March, a little more than a month after her interview. We would like to return to her home and have another wedding that her family can be a part of as well. We are planning the second wedding for October. What can anyone tell me about the Advanved Parole.

Hi :)

When the foreign fiance enters the states using the K1 visa and applies for AOS (Adjustment of Status) and EAD (Work Authorization) at the same time they apply for Advanced Parole.

Advanced Parole allows the foreign husband/wife to travel outside the united states after marriage but before receiving a green card.

They can leave the states at any time but they will be denied re-entry without AP or a green card.

Usually AP is received within 90 days of filing for AOS. Sometimes sooner, sometimes later.

You won't be able to return home to her home country until she has that document or you will have to start over with a spousal visa, either the K3 or CR-1.

Based upon current data, allow at least 140 days from K-1 entry to advanced parole/green card. If you can stretch that timeline, all the better for success.

Schedule in the possibility of a processing delay.
