Fiance Visas in Delhi

Timeline

Ok so I am hearing more and more that sikhs in Punjab are getting more and more rejected for visas(fiance). Reason is twofold, first that they use common last names(Kaur or Singh) and secondly, they has been a rash of fraud from so called travel agents in that region.

So I was denied the first time.. and reapplied., just got the approval and it is in NVC. Any advice on how to try to persuade them not to deny it this time around.

I plan to actually go for the interview this time. I have already started to get letters of support from both sides of our families. Two congressmen and a senator have been informed and they will submit letters of support and also call into the embassy prior to the interview.

I dont know what else to do.

Someone mentioned that since I went to india 4 timesthat the embassy might question why I didnt get married.

Summer 2006(engaged)

Feb 2007- a wedding

Sept 2007

all the trips were for 5-7 days since I can not take more time from work. Also, my entire family lives in the states along with my neices and nephews... hence the reason to get married here..

any advice?

K1 Visa Timeline :

07-27-2007- Sent out I-129f

08-07-2007 : Received NOA1

12-23-2007 : NOA2 approved

12-27-2007 : NVC Received

01-10-2008 : Case forwarded to New Delhi Embassy by NVC.

01-14-2008 : New Delhi Embassy received our file from NVC.

01-24-2008 : Submitted Packet 3 at New Delhi Embassy.

02-06-2008 : Submitted docs at VFS.

02-21-2008 : Interview- visa was approved pending security.

02-25-2008 : Called NVC and they said Visa is approved. VFS- they didnt get it yet.

02-27-2008: Visa in HAND!!!!

03-08-2007: Arrived at POE(JFK)

May 12-2008- Got the Marriage License

May 19-2008- Married!!!

AOS

06-06-2008 Mailed out AOS

06-08-2008 Delivered to Lockbox

06-16-2008 NOA for EAD, AP, AOS(dated June 12)

06-28-2008 Biometrics done!

It sounds to me that you are doing everything you possibly can. The common last names might be a pain but what to do. As for proof, you have a lot! Besides everything else, make sure your sponsorship has everything and more, because they are sensitive about that - like letter from your employer, taxes for last 3 years, pay stubs for 6 months etc. Along with photos of both of you, you can include an explanation letter if you want, about why you want to marry in the States. Also affidavits from family (yours and his) will help too. Knowing that the families approve is a big positive sign.

I think more than the regular paperwork... you neeed more proof of your relationship which is concrete... just proove that to them..... I am also worried about my interview for the same....

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

Sept 26,2007- DS-230 Delivered.

Oct 1,2007 - NVC has DS-230.

Oct 12, 2007 - DS-230 Reviewed. Case Complete

Oct 16, 2007 - Case at Embassy.

Oct 25, 2007- Interview Letter Despatched from Embassy.

Nov 3, 2007 - Recieved Interview Letter.

Dec 1, 2007 - Medical Exam .

I GOT IT

Jan 16 - I am in USA

April 15 2008 - Get my Drivers License.

I-751 Lifting Conditions at California Service Center

November 12, 2009 - I-751 Sent via USPS Express Mail

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

Looks like you have done all your ground work. Try to have proof of gifts exchanges between you folks (e.g. like jewellery receipts, etc.)

Definitely, letters/affidavits from both family members helps!

03/10/2008 : Case Completed!

03/20/2008 : Interview Scheduled & Interview letter mailed

03/25/2008 : Beneficiary received interview letter

03/25/2008 : Case forwarded to consulate. NVC message updated on 3/28/08.

Consulate

05/22/2008 : Interview

05/22/2008 : Visa granted and passport collected same day.

05/26/2008 : POE (Newark, NJ).

I think going personally would definitely help...Not sure if you will be allowed to accompany your fiancee inside the consulate but she can definitely mention that you are there(in person) to alleviate any doubts on part of the consular official.
