Hello all,

I have been asking for advice several times here and a lot of you have been so helpfull.

Our lawyer never did anything right for us making us lose months and months in the process.

Each and everytime we ask him a question he gets upset and if we ask anything that has not been written in the agreement he tells us we have to pay more if we want his services.

We were asked $1,500 to start the process and will be asked $1,500 after I get to the U.S.A.

I have three children and just found out he might also have screwed them up on the immigration application, we are looking into it. He denises all the mistakes he makes because he is "an immigration specialists and knows what he does".

There are a few things on the agrement that have not been respected like him saying the process will take 8 months at the maximum but that he sill do his best to make it shorter etc... Well we have the 8 months since we hired him last April.

I don't know if we can tell him we don't want to work with him anymore and not pay the remaining $1,500 or if we can't.

Does anyone have any kind of legal advice for us?

07/18, 23 and 25/08 Physicals

08/30/08 Employment Authorisation (valid for 1 year)

08/30/08 Authorisation for Parole

11/19/08 SSN (valid for work only)

12/04/08 Initial Interview appointment / Rescheduling requested

02/03/09 Interview appointment / very easy, very nice officer, not too many questions, our evidences were enough

02/03/09 Green Card granted for the four of us

02/16/09 Green Cards arrived in the mail

If you signed a contract to pay $1500 to start, and $1500 upon completion you may have a problem unless you can prove incompetence. A good question for another lawyer.

As for the 8 months, that was a reasonable estimate, the lawyer could not predict the un-predictable like lengthy name checks, and other slowdowns at USCIS to to the rush to file last summer.

Have you tried calling the USCIS regarding your petitions because I see your cases are still pending. I know the USCIS is backlogged. Sometimes, you gotta do things yourself and call the USCIS. Just hang in there.

But, I donno about the lawyer issue, it's your decsion =)

Wasnt it your lawyer who offered to get your translations done by a non-approved translator for $400?
I am glad that I did the entire immigrations case my self, I saved a bundle, as well as a lot of time.

No kidding, look at that $3000 timeline (not picking on the poster, but shaking my head in disgust at how little ownership lawyers show to this process)

If the lawyer has not kept up his end of the contract (promising to have this completed in 8 months) then you have every right to fire him and ask him to turn over your file to you. There really is No Way for a lawyer to speed up this process, I don't know why they continue to tell clients they can. Other than the fact they're dirty and rotten :P

Fire the lawyer and finish the rest of it on your own. And fire him in writing, and keep a copy of it for yourself and send it via courier so you know the exact date and time it was delivered, so if he tries to invoice you for anything after that (other than probable copying and courier costs to send your file back to you) you shouldn't need to pay for any "services" after the date he receives the letter.

We had a two separate lawyers mess up our stuff initially, and one of them even after being fired continued to phone my husband "to check on our progress", and then had the balls to send an invoice for the time spent on the phone call :wacko: When he finally got it thru his thick skull we no longer needed his services, he sent the sheriff round with a notice to pay the last invoice or be taken to court. eejit...so we paid it, then told any and everyone we ever met that he was a crook and to stay away from his office :P

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

Thank you all very much for your advice.

It looks like we have no choice but to finish with him because of the contract we have and we all know how difficilt it is to prove a lawyer is wrong.

Anyways we have learnt our lesson and will handle things ourselves for the AOS. We asked him a question about it and he told us he was not paid for this part so he won't give us advice...

I saw that a lot of you who have applied for CR-1 are already approved and so more further in the process. I can't beleive this idiot made us take the longest and most expensive route again. I'm really disgusted at lawyers and USCIS now...
