Lifetime Ban but the consular didn't ask for 601 waiver?

Hello everyone, Hope you guys are doing well.

My dad just had his interview for a green card sponsored through my brother. He has a lifetime ban on his file for misrepresentation and fraud, he had 2 different names his whole life

and he unknowingly made government IDs in two different names (1994-1995ish). After his interview he was denied VISA but was told to bring in additional documents like police reports 

and witness letter proving he had two names.  However They didnt ask for a 601 waiver, we were anticipating them to ask for it. Just wondering what may be going on.
