E2 and getting married

I'm from Austria, I moved to the US abt 3.5 years ago via an E2 visa. My visa is still good for 1.5 years, my lawyer said at the beginning of the process he would apply for the greencard together with the last year, but actually the I 94 updated the last time I left the country and I'm leaving again in a couple months so it should then be OK until the end of my visa.

 

I wanted my greencard via my job, so I did not really wanted to get married before, but my bf (American, divorced with 2 kids) and I are now planning on buying a house and moving in together, while living in a state that does not allow unmarried couples to live together with kids and we suspect the kids' mother to make drama so we might as well get married now, but not sure how it works. Can we just get married and I then apply for the greencard or do I need to change my visa before to a different one and could I still continue to work at my job?

It sounds like you are in the US right now. If so, you can do AOS fine...no need for a new visa.

Marriage to a USC permits concurrent filing of the I-130 + I-485. No need to wait for approval first.
