I-864 child not declared as dependent on ITR

My USC husband's minor child is not declared as his dependent on his ITRs. He said it's his ex wife who puts the child in her yearly ITR as her dependent.

My husband gives child support.

Shall I put his child as his dependent on the form I-864? If I do so then the info on the I-864 and my husband's ITRs will not be uniform. Cos there's no dependent on the ITRs and there's a child dependent on I-864.

A minor child is always claimed on the I864 as a dependent.. This is not about who claims the person on taxes but an accounting of the people you are obligated to provide support for. He has to declare as fully dependent all minor children, as partially dependent any non minor children he help ( like a college kid ) and any immigrants he previously sponsored that he is still on the hook for

This will not be over quickly. You will not enjoy this.
