Need Help!!!! Children of I130 & I129F, Concurrent Petitions, K4 Visa Process

Good Evening, Need help on including children of my Spouse as well. I have heard it is advisable to file both petitions (i130 & I129F) to avoid seperate petition fees and speed up the process with Immigration. I need to assure that my wife's children travel at the same time as my wife, because theres is no option of leaving behind. Anyone familiar with this process or can point to more information??

Whoever said it was "advisable to file both petitions (i130 & I129F) to avoid seperate petition fees and speed up the process with immigration" is clearly behind in the times.

Filing both petitions to start the K3 process A) does not speed up the process and B) is essentially a dead end. Here's why, current procedure at USCIS is to tie the two petitions together and adjudicate them at the same time, this has been taking place since 2006. Furthermore, the NVC implemented a procedure in 2010 that if they have an approved I-130 on station, the K3 process is administratively closed. For the last five years, pursuing the K3 process has saved no time and issuance of a K3 visa (and the derivative K4) is a very rare occurence.

If you were to try to do the K3 and derivative K4, it will likely end up as most do these days, administratively closed. At that point, you would have to file petitions for each of the kids and wait until they were approved and sent ot the NVC before proceding further.

If you want to assure that the kids travel at the same time as your wife, you need to file petitions for them at the same time you file the petition for your wife.

Every member will need their own petition. I-130 is the petition you will file. The requirements for the children are minimal in terms of supporting documents in comparison to the spouse. Follow the I-130 instructions. Make sure EACH petition has its own entire set of document copies so they can be reviewed individually. Submit them at the same time and they will be "married" to each other during the process though different people may review them. Take some time to read through my signature. It was myself and my two young children. You can see that even though I did things at the same time for us, it was not always the exact same timing on the other end.

You want to keep in mind when preparing the files that you have each of them able to stand on their own merit. A lot of people incorrectly assume that they only need to send one copy of the supporting documents.
