Unpaid Internship allowed?

I am here in the states on an F1 Student Visa and I have filed for AOS and EAD in December. I know I am not allowed to work until I get my EAD card (or I can work On Campus of the University I attend). There is an Internship that is being offered with a company in town and I know I cannot take it and get paid, but Can I take it as an unpaid internship??

The reason I am willing to do an unpaid internship is that because it is in my field of study and I know that eventually they gonna have that position as full time and being an intern there and having worked in that position would make me more favorable to get it if it becomes a Full time Job.

Anybody knows anything about this ???

You cannot accept a position, without being paid, that someone else could be paid to do.

i.e. you can volunteer at church but you cannot volunteer in a coffee shop

I atually had a similar question... I have a resume online and was contacted. I wrote them and said that I would not be work Authorized for 2-3 months, and could I contact them at a later date.

I was informed that I would have to undergo a training period and some courses which would be unpaid. Would this be ok??

( I was contacted by a real estate agency)

well, I just contacted the office of International Students at my university about this. I guess in order to do an internship, you need to apply for what is called "CURRICULAR PRACTICAL TRAINING" or CPT. This is to be approved and granted by the university and not the USCIS unlike the OPT. In order to qualify for a CPT you need to be registered for a class that is specific for Internships (i guess it could be independent study or something like that).

Since this semester already started and i am not registered in any class like that, i am not gonna be able to apply for a CPT to do an internship.

too bad, but it's ok. i guess i will just wait on my EAD

looking at your signature, it says that you entered the U.S. through JFK and that you are work authorized (they stamped your passport), so you ARE allowed to accept that job and get paid for it.

What about asking the organization if you can intern there. They can hire someone for the paid internship and maybe you could be a second free intern. They might not want 2 interns, but then again they might be happy to accomodate you.

oh sorry for the confusion..I havent updated my signature in while.... My I-94 expired two days ago, so I am officially unemployable while I await the EAD, and have only just mailed off. ( was waiting for 2006 W2) So, the wait begins.......

That's why I wondered if I could " train" for something. Im guessing Ill be waiting about 2-3 months from now :)

Based on Jen's post above, it would still be considered illegal since only volunteer work is allowed.

in addition, i am sure that the company want to document who is physically present at their office and if they ever get audited they can get in trouble for allowing me to work there.

Some internships though are by nature unpaid and therefore done on a voluntary basis. If the organization lets you "volunteer" as an intern or creates a volunteer position for you then you won't be taking a paid job from anyone. I'm sure that the UN has lots of unpaid volunteers as long with some other types of international organizations.
