Embassy asked for police records that have expunged

Hello, I am new to this site but was wondering if anyone has encountered my situation. My husband is waiting on his visa in El Salvador. He had an appointment in June 2013 was told he needed I-212 due to 2 deportations- he has been waiting since 2002 to get his visa. I 212 was approved march 31st. I scheduled him an interview through the website and he went for his appointment. He was told all he needed was a new medial exam and they would send the passport stamped with visa in the next few days after they recieved the medical reports. He then was called a few hours later and was told he needed police records from a crime he committed in 1999. I had this sealed for him in 2006 it was for forgery 2nd degree. We did attach this with his application. But now they are saying they need police records and might be in trouble since we didn't put it on his application? I am guessing after much research that it is a crime of moral turpitude which we didn't know about. Does anyone know if you have a record sealed or expugned if it would still make you inadmissable? I am so worried- we were so happy then so disappointed after the call. I would guess we may have to fill out a I601 waiver. Wouldn't they have checked this in 2013 when he had his first interview?

There is no such thing as expunged for visas. You will need documentation about the crime. An expunged crime can still make you inadmissible. Forgery is a CIMT.

Thats what I told my husband. That didn't pull up any police reports I guess it's on his immigration file. It's just been a nightmare. We hired an attorney that was recommended from family and he took alot of our money and didn't do anything and then a couple months later he was arrested for being a fraud. The police took all the records in his office and would not release them due to them being evidence. I am having to do everything myself and have learned quite about the immigration process.
