Visa Bulletin for May 2010 was updated for F2A to 01Dec2006 - so next month May 1, 2010 I'll be able to apply for AOS :star: so happyyyyy. :dance::D

Anything new in your end? Did you get any police certificates (eventhough never had problems with the law anywhere) or they only care about biometrics here in USA.

Have you done a medical examination?

I needed chest Xray due to a TB skin test positive, It was a pain, took a long time.

And as far as I know, we are not required to submit the police certificates for AOS.

I haven't received any news from USCIS, but will keep you update (L)(F)

I just got today the medical exam done, my TB test was negative (even though I had the BCG vaccine when I was little, sometimes that will give false positive). Some of the vaccines she put the dates based on my immunization records and others wrote "not age appropriate" (I believe the ones that USCIS does not consider important. I hope that's gonna be ok.

Now, I am trying to prepare the other forms and have them ready by May 1 ;) let's see how this other stuff goes, trying to get the envelope ready to go. I will have more question I am sure :)

I think soon you'll hear from them. Keep fingers crossed for that interview date to come fast. (F) (F) (F) (F) (F)

So glad to hear from you nekomyu. I could not believe my eyes when I saw the bulletin. I thought I had more time to put everything together, I should have listened to you. But I'm not gonna complain :):star:

It's been more than 3 yrs. that my I-130 is still pending.

I called USCIS Service Center last friday (April 16) and explained my situation. They have put a service request for me. I also told them that according to May Visa Bulletin the visa number for my case is going to be available next month.

What did you guys do when you were in that situation?0 I have already called USCIS several times since I filed my I-130, but it's not helping much.

Looking forward to your advice.

With the help of my VJ friend nekomyu, I contacted the USCIS by emailing them at Texas Service Center. I emailed them then they responded with this email below in "blue"

In order to make a service request and speak to a Customer Service Representative, please follow the below instructions:

Due to the variety of this kind of case, please check our website at www.uscis.gov for current processing times. You can also register there to get automatic e-mail updates as we process this case."

my question is:-

1. Why should they care about the availability or unavailability of immigrant visa. Shouldn't they just go ahead and approve I-130 when it is already outside of normal processing time???

2. If I-130 was approved, it would go to NVC and they would start asking for the required documents, which would make the total NVC processing times faster.

Folks, need your advice. Should I go ahead and email them now or just wait for the next visa bulletin to be released?

Back on the days when I applied for I-130, USCIS was approving I-130's in about 6 months, but then the processing dates stopped and stayed the same processing date for three years. They have not touched those cases for a long time since visa numbers did not move much within the past years (due to the fact that more people apply than yearly visas are available). Now since the USC application is about 3-4 months in most cities a lot more people will wait for their spouse to become USC and then apply to come here. That's why last month Visa bulletin moved forward 6 months :star:

Now, USCIS is trying to catch up with the new visa bulletin, but they seem to "forget" to approve some of the old cases, so that's why you need to go ahead and "remind them" that you are in line next to be approved.

The letter you got from USCIS seems something that they will send to anyone in these type of inquiry. Just keep focus and do whatever needs to be done for that case to get approved (even if it means calling/emailing them every singe day :rofl:

Yeah exactly they don't seem to approve a petition until the visa number is available for the case. I wrote them an email and now they said that they have requested my file from their record department for review. I hope something will be good.

And yes not too many people like us (delayed I-130 Approval) I think both of us are the lucky ones LOL but let's hope the rest of the journey goes smooth now (F)(L):)

My NVC Journey

10/12/10 –NVC received the file

10/15/10 -NVC case # generated

10/18/10 -Called NVC and gave both beneficiary and petitioner email addresses

10/19/10 - Beneficiary emailed DS-3032 to NVC and also mailed the hard copy

10/26/10 - Called NVC and got the IIN

10/26/10 - Paid AOS fee $ 88.00

10/27/10 - AOS fee status shows "PAID"

10/27/10 - AOS package expressed mailed (next day delivery)

10/30/10 - IV fee bill generated and paid immediately

10/30/10 - Received AOS fee bill and DS-3032 kit and also received the confirmation of receipt of DS-3032

11/04/10 - IV fee bill status shown as "paid"

11/04/10 - Sent IV package (next day delivery)

11/06/10 - Received IV instructions packet (packet 3) via email

11/08/10 - AOS entered into NVC system

11/16/10 - AOS was reviewed and OK'ed

11/18/10 - IV entered into NVC system

11/24/10 - IV package was reviewed and generated artificial RFE for missing photographs (which was actually submitted with the package)

11/26/10 - RFE response mailed out

11/29/10 - RFE response delivered to NVC

12/08/10 - RFE response entered into NVC system

12/15/10 - SIF :)

12/15/10 - Case Complete :)

01/03/11 - Interview date assigned for Feb 15 @ 1:30 PM

01/17/11 - Medical done ! Passed

01/25/11 - Re-scheduled the interview for Feb 1 @ 1:00 PM

02/01/11 - Interview @ 1:00 PM - Approved :)

02/03/11 - Visa picked up from USEM

02/12/11 - POE @ JFK

Did you check online if they have touched your I-130 recently? They touched our I-130 several times before getting the approval notice (email notification), so let me know. (F)(L)

For us it took a couple of weeks for them to review our case and make a decision from when the email was snet to "investigating" unit (officer).

I have been checking the status of my I-130 fifty times a day :D but it doesn't have any touch update :(

It's already a week now that they started reviewing my case. I will wait for another week and send them an email again.
