Nekomyu,

Visa Bulletin for May 2010 was updated for F2A to 01Dec2006 - so next month May 1, 2010 I'll be able to apply for AOS :star: so happyyyyy. :D

Anything new in your end? Did you get any police certificates (eventhough never had problems with the law anywhere) or they only care about biometrics here in USA.

Take care

Have you done a medical examination?

And as far as I know, we are not required to submit the police certificates for AOS.

So glad to hear from you nekomyu. I could not believe my eyes when I saw the bulletin. I thought I had more time to put everything together, I should have listened to you. But I'm not gonna complain :):star:
I just got today the medical exam done, my TB test was negative (even though I had the BCG vaccine when I was little, sometimes that will give false positive). Some of the vaccines she put the dates based on my immunization records and others wrote "not age appropriate" (I believe the ones that USCIS does not consider important. I hope that's gonna be ok.

Now, I am trying to prepare the other forms and have them ready by May 1 ;) let's see how this other stuff goes, trying to get the envelope ready to go. I will have more question I am sure :)

I think soon you'll hear from them. Keep fingers crossed for that interview date to come fast. (F) (F) (F) (F) (F)

Hi SweetApple08,

First of all thanks for creating this discussion thread.

I have been going through the same situation as you were and thought to share with you all and get some advise.

I applied I-130 for my spouse on Dec 2006. It was first sent to Vermont Service Center. On November 2009 It was transffered to Nebraska Service Center. Again in January 2010 They transferred it to Texas Service Center. According to the I-130 processing time of Texas Service Center, my I-130 is out of current proccessing time which is 5 months. It's been more than 3 yrs. that my I-130 is still pending.

I called USCIS Service Center last friday (April 16) and explained my situation. They have put a service request for me. I also told them that according to May Visa Bulletin the visa number for my case is going to be available next month.

What did you guys do when you were in that situation?0 I have already called USCIS several times since I filed my I-130, but it's not helping much.

Looking forward to your advice.

Thanks,

Hi withoutu,

With the help of my VJ friend nekomyu, I contacted the USCIS by emailing them at Texas Service Center. I emailed them then they responded with this email below in "blue"

Thank you for your recent inquiry regarding your application. If your inquiry is case-specific, please call and speak to one of the officers or you can make a service request at the National Customer Service Center.

In order to make a service request and speak to a Customer Service Representative, please follow the below instructions:
1. Call 1-800-375-5283
2. DO NOT ENTER A RECEIPT #
3. Select the prompt 1
4. Then select the prompt 2
5. Next select the prompt 3

At that time you will be connected to a Customer Service Representative and advise them you would like to make a service request. I hope you find this information helpful.

This office only accepts an inquiry after an initial service request is made with the National Customer Service Center. If you have made a service request and not received a response after 30 days you may contact us with a referral tracking number and/or an identification number of the person you spoke to regarding your case. This information will assist us in better serving you.

As a courtesy, we can inform you that the status of your case may be obtained online at https://egov.uscis.g...s/Dashboard.do.

To inquire about the acceptance and/or rejection of applications or petitions filed, please contact the Lockboxsupport@dhs.gov email address.

I hope this information is helpful.

THEN I EMAILED THEM BACK:

Good Afternoon,

I have opened a request with a Customer Service Representative

Request Confirmation number is TIF........VSC and Date of request was ........ (30 days ago)
Receipt number EAC-06-......
Received Date: ...............
Notice Date: ..................
Petitioner: ...... A#.......
Beneficiary: .......... A#............ (if you have one for spouse)

According to processing times the I-130 petition filed is outside processing times: filed 41 months ago, both VSC (I-130 petition is processed 29 months) and TSC (I-130 petition is processed in 5 months) processing times are well below my I-130 application processing time.

The Department of State has moved forward to process applications from April 2006 (interviewing spouses of permanent residents) while our I-130 is still in the initial stages. If you need any additional information do not hesitate to contact me .......

This case is assigned to an officer for review. As of today, no final decision has been made or additional information requested. You will be notified when a decision is made or if USCIS needs additional information from you. Please allow up to 30 days before a decision is made.

In a matter or days it was touched and a couple of weeks approved.

Thank you very much for your reply SweetApple08. I have been reading the conversation between you and nekomyu. You guys are very helpful.

Well, I have put my second service request to USCIS on April 16 and haven't heard back from them yet. I am thinking to email them after they respond to my service request.

Your information is very helpful. Meanwhile I wish you all the best in your future endeavor.

Good Luck to you too. Keep us updated!

I have received a reply from USCIS in response to my second service request, the letter says as follows:-

"The immigrant visa is not immediately available from the Department of State. We process each kind of case in the order we receive them. You can use our processing times to estimate when we will make a decision on your case. Due to the variety of this kind of case, please check our website at www.uscis.gov for current processing times. You can also register there to get automatic e-mail updates as we process this case."

my question is:-

1. Why should they care about the availability or unavailability of immigrant visa. Shouldn't they just go ahead and approve I-130 when it is already outside of normal processing time???

2. If I-130 was approved, it would go to NVC and they would start asking for the required documents, which would make the total NVC processing times faster.

Folks, need your advice. Should I go ahead and email them now or just wait for the next visa bulletin to be released?

Waiting for your suggestions friends.

Back on the days when I applied for I-130, USCIS was approving I-130's in about 6 months, but then the processing dates stopped and stayed the same processing date for three years. They have not touched those cases for a long time since visa numbers did not move much within the past years (due to the fact that more people apply than yearly visas are available). Now since the USC application is about 3-4 months in most cities a lot more people will wait for their spouse to become USC and then apply to come here. That's why last month Visa bulletin moved forward 6 months :star:

Now, USCIS is trying to catch up with the new visa bulletin, but they seem to "forget" to approve some of the old cases, so that's why you need to go ahead and "remind them" that you are in line next to be approved.

The letter you got from USCIS seems something that they will send to anyone in these type of inquiry. Just keep focus and do whatever needs to be done for that case to get approved (even if it means calling/emailing them every singe day
They seem to care about visa numbers to approve applications because they don't want to receive applications which are submitted way to early for AOS or CP.

Yeah exactly they don't seem to approve a petition until the visa number is available for the case. I wrote them an email and now they said that they have requested my file from their record department for review. I hope something will be good.

Thanks SweetApple for your sweet reply :)

I guess we don't have that many people in VJ from F2A category waiting for their approval and whose I-130 is outside current processing date

Did you check online if they have touched your I-130 recently? They touched our I-130 several times before getting the approval notice (email notification), so let me know. (F) (L)

For us it took a couple of weeks for them to review our case and make a decision from when the email was snet to "investigating" unit (officer).

I have applied for AOS (in USA) and waiting for first notification letter.

I have been checking the status of my I-130 fifty times a day :D but it doesn't have any touch update :(

It's already a week now that they started reviewing my case. I will wait for another week and send them an email again.

Thanks SweetApple.
