I-134 Receiving Child Support Tax Returns Assets

Dear All,

Received our NOA2 on October 4th and are now working on the next stack of paperwork. I have a few questions regarding the i-134:

- I receive child support for my two children who live with me 50% of the time. Do I add this child support to my income? If so, what proof do I need to add?

- I have read to include only dependents on the tax returns on the I-134 form. We each claim one child, but both of them live with me part-time. It would make sense that I list both of them as dependents on the form regardless of the taxes, correct?

- I read several conflicting answers on this topic in this forum: how many years of tax returns/transcripts do I need to provide? I want to say just one but not sure.

- Lastly, if my income is more than the required poverty line minimum, do I need to list additional assets or can I simply skip that? My income is also slightly more than the 125% required for the Green Card.

- I have read to include only dependents on the tax returns on the I-134 form. We each claim one child, but both of them live with me part-time. It would make sense that I list both of them as dependents on the form regardless of the taxes, correct? I think that is a hard question especially if you are going to declare the child support. If you did not declare the child support, I think declaring one child is safe and defensible and uncomplicated since it matches your tax returns.

You only need tax returns if you have no other way to prove income (letter from employer and pay stubs for example). The instructions say to file your most recent tax return if you are self employed. Embassies differ. Check you country specific sub forum for what Argentina wants.

Make sure you have your house hold number correct when looking at the poverty level.

Both of your children will be considered part of your household regardless of how often they're with you, so your household will be 4, you, your two children, and your fiance.


With that said, yes you can show court order and/or bank statements to prove child support.

You need one year of tax returns, the most recent year.

As long as you make enough to cover 125% of the poverty line for a household of 4, you're fine. No need to show assets unless you want too. Just make sure to show proof of current income, like pay stubs, employer letter, etc.
