Hey I had my K1 Visa interview on January 6,2024 and I was asked to submit my original divorce certificate and I did submit on January 10. Till now my visa is not issued. Why is your case on administrative process?
Monsuru on 2025-01-26 said:
Hello everyone, please I had my K1 visa interview in January 21, 2025 after waited a year for an interview, the officer says I'm sorry I refused you and she gave me a white paper this is what they wrote there. Dear Petitioner: We are unable to issue a visa in the above -mentioned case because the applicant has been found ineligible under Section 221(g) of the INA act this section prohibits the issuance of a visa to anyone whose application does not comply with the INA or regulations issued pursuant thereto.   Unless revalidated, I-129F petition are only valid for four (4) months from the date of the last action by USCIS or this consular Officer. We are not able to revalidate the above case file (s) and will return to the NVC which will then transfer the case to USCIS office originally processed the subject petition (s) Because the petition will have expired by the time the USCIS receives it, USCIS will not reopen the case. Please do not contact the U.S. Embassy or NVC regarding this case.

Monsuru on 2025-01-26 said:
No she didn't tell me the reason why she refused me, when I login into CEAC account it saying, A U.S. consular officer has adjudicated and refused your visa application. Please follow any instructions provided by the consular officer. If you were informed by the consular officer that your case was refused for administrative processing, your case will remain refused while undergoing such processing. You will receive another adjudication once such processing is complete. Please be advised that the processing time varies and that you will be contacted if additional information is needed. For more information, please visit TRAVEL.STATE.GOV or the website for the Embassy or Consulate at which you made your visa application.

Dear Applicant: Greetings from U.S. Embassy Accra’s Visa Unit. As your visa interview date approaches, you are required to appear at the embassy for a pre-screening appointment on December 16, 2024 at 8:00am. Please bring a government-issued photo ID and a copy of this letter. Your name will be added to the access list at the Consular entrance. This pre-screening appointment is scheduled approximately three (3) weeks before your actual visa interview and will allow consular staff to review your documents to ensure you are ready for your interview with a consular officer. Your interview is scheduled for January 21, 2025 at 7:00am. Below is a list of required documents. Please bring these documents to your pre-screening appointment. Consular staff will review your case and inform you of which documents you are still missing. Since the pre-screening appointment will take place several weeks before your visa interview, this will allow you enough time to seek any required documents (including any that must be sent from abroad) in time for your visa interview. Please bring the following documents to your pre-screening appointment. You must bring ORIGINAL DOCUMENTS – plus any requested photocopies. 1. DS-160 Confirmation Page 2. Passport(s) plus one (1) photocopy of each passport: For all applicants intending to travel to the U.S. Passport(s) must be valid for at least six (6) months beyond your intended date of entry into the U.S. 3. Birth Certificate(s) plus one (1) photocopy of each certificate: Green/biometric vers ion, for all applicants intending to travel to the U.S. 5. Divorce and/or Death Certificate(s) plus one (1) photocopy of each certificate: If applicable, of any previous spouse(s) for both you and your U.S. citizen sponsor. 6. Ghana Police Certificate: For all applicants aged 16 or older. 7. Other Police Certificate: If applicable, from any country other than Ghana that any applicant has lived in for over one (1) year while age 16 or older. Finally, don’t forget to: 1. Complete your medical exam at least three (3) weeks before your visa interview. Make sure to bring your visa case number and passport to your medical exam. 2. Bring all applicant passports to the visa interview. 3. Bring proof of your relationship with your U.S. citizen sponsor to your visa interview. Phones are not allowed in the consular section. Please PRINT your photos, chat records, money transfer receipts, or other evidence you would like to show to the consular officer. 4. Verify that the names and dates of birth for all applicants are the same on all documents. If any applicants have changed their name or date of birth, please bring documentation and/or a written explanation detailing the change (i.e. Ghana Gazette and Sworn Affidavit). 5. Create an account and select your OIS or DHL delivery location at https://www.usvisaappt.com/visa/country?country=GH. This is how we will return your passport and doc uments to you once your case has been adjudicated. If you do not appear at your prescreening appointment on the date and time indicated above, you will be asked to reschedule your visa appointment. If you need to reschedule your prescreening appointment, you can do so by emailing ConsularAccra@state.gov. Type "PS77" in the Subject line. Please include your case number, prescreening date, and reason for requesting rescheduling. Please note that prescreening appointments are limited, and the consular section cannot guarantee your appointment will be rescheduled. We will consider requests on a case-by-case basis.

Monsuru on 2025-01-26 said:
Why do we have to refile again?
blank avatar DeJunior on 2025-01-26 said:
This is because when they refused you K1 Visa, the file will return back to USCIS and they will closed the case. So the couple will have to re file again a new case or reach out to the senator of your state of residence to intervene.
Monsuru on 2025-01-31 said:
Greetings, Case notes indicate the interviewing officer’s decision to return the petition to USCIS for review and possible non-revalidation. The action followed the officer’s interview in which it was determined that the beneficiary is not eligible for the immigrant benefit for which they are applying. When USCIS receives returned K1 petitions, they do not send the petitioner a Notice of Intent to Revoke (NOIR) as they do with I-130 petitions. Therefore, the petitioner can either file another K1 petition or marry the beneficiary and file an I-130 spousal petition. There is no further action to take with this office. "This is the replied I received from the embassy today"
blank avatar DeJunior on 2025-01-31 said:
I’m sorry to hear that. Y’all will just have to file another case again.

*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the USCIS processing times to see if your application
is past due.
